A deeply troubling judgment
The recent conviction and sentencing of lawyers Imaan Mazari and Hadi Chattha for social media expression raises serious constitutional and legal concerns.
Freedom of speech, due process, and the right to fair trial are not privileges, they are fundamental rights guaranteed by the Constitution of Pakistan.
Criminalising dissent and punishing expression through excessive sentences undermines public confidence in the justice system and weakens the rule of law. Courts are meant to protect rights, not suppress them.

📌 Revision against acquittal is NOT maintainable where appeal lies
The Lahore High Court (Multan Bench) has reaffirmed a key criminal law principle regarding acquittal under Section 249-A Cr.P.C in it's recent judgment.
● Key Holding:
An order passed by a Magistrate under Section 249-A Cr.P.C. is an order of acquittal, even if passed without recording evidence.
● Correct Legal Remedy:
Any person aggrieved by such acquittal must file an appeal under Section 417 Cr.P.C.
👉 A criminal revision is barred under Section 439(5) Cr.P.C.
● Sessions Court has NO jurisdiction to entertain revision against acquittal, set aside the acquittal or order retrial of the accused.

لاہور ہائی کورٹ (ملتان بنچ) نے واضح کیا ہے کہ جب مجسٹریٹ دفعہ 249-A ض ف کے تحت کسی ملزم کو بری کر دے تو وہ مکمل طور پر بریت کا حکم ہوتا ہے، چاہے یہ حکم بغیر شہادت ریکارڈ کیے ہی کیوں نہ دیا گیا ہو۔
ایسی بریت کے خلاف درست قانونی طریقہ دفعہ 417 ض ف کے تحت اپیل دائر کرنا ہے۔
بریت کے حکم کے خلاف ریویژن دائر کرنا دفعہ 439(5) ض ف کے تحت ممنوع ہے اور سیشن کورٹ کو نہ تو بریت ختم کرنے اور نہ ہی دوبارہ ٹرائل کا حکم دینے کا اختیار حاصل ہے۔

⚖️ Exclusive Jurisdiction of Family Courts – Custody of Minors
(PLD 2023 Lahore 433)
As held by the Lahore High Court, the Family Courts Act, 1964 has been enacted for the expeditious settlement of disputes relating to marriage and family affairs. Subject to the Muslim Family Laws Ordinance, 1961, the Family Courts have exclusive jurisdiction over matters mentioned in Part-I of the Schedule, including custody of minors and visitation rights.
By virtue of section 25, the Family Court is deemed to be a District Court for the purposes of the Guardians and Wards Act, 1890, and no other court, including the Guardian Judge, has jurisdiction in custody matters, except where expressly excluded.
Proceedings under the Mental Health Ordinance, 2001 operate in a distinct field and do not curtail the jurisdiction of Family Courts, particularly as no minor can be left without a guardian or custodian.

(PLD 2023 لاہور 433)
لاہور ہائی کورٹ کے مطابق فیملی عدالتوں ایکٹ، 1964 ازدواجی اور خاندانی معاملات سے متعلق تنازعات کے فوری اور مؤثر تصفیے کے لیے نافذ کیا گیا ہے۔ شیڈول کے حصہ اوّل میں درج معاملات، بشمول نابالغ بچوں کی تحویل اور ملاقات کے حقوق، پر خاندانی عدالتوں کو مکمل اور خصوصی دائرہ اختیار حاصل ہے۔
دفعہ 25 کے تحت فیملی عدالت کو گارڈینز اینڈ وارڈز ایکٹ، 1890 کے لیے ضلعی عدالت تصور کیا جاتا ہے اور مستثنیٰ حالات کے سوا کسی دیگر عدالت، بشمول گارڈین جج، کو اختیار حاصل نہیں۔
مینٹل ہیلتھ آرڈیننس، 2001 کے تحت کارروائیاں ایک علیحدہ دائرہ اختیار میں آتی ہیں اور وہ فیملی عدالت کے اختیار کو محدود نہیں کرتیں، کیونکہ کسی نابالغ کو سرپرست اور متولی کے بغیر نہیں چھوڑا جا سکتا۔
