Punjab Labour Appellate Tribunal نے اپیل کو مسلسل غیر حاضری اور مقدمہ کو سنجیدگی سے فالو نہ کرنے کی وجہ سے خارج کیا تھا۔ درخواست گزار نے اپیل کی بحالی کے لیے یہ مؤقف اختیار کیا کہ تاریخ غلط نوٹ ہو گئی تھی، مگر عدالت نے اس وضاحت کو ناکافی قرار دیا۔ ریکارڈ سے ثابت ہوا کہ درخواست گزار متعدد بار غیر حاضر رہا اور بار بار التواء لیتا رہا۔ ہائی کورٹ نے قرار دیا کہ مسلسل غفلت اور تاخیر کی صورت میں بحالی کا کوئی معقول جواز موجود نہیں، لہٰذا درخواست خارج کر دی گئی۔

Wife Can Challenge Conditions of Khula Decree Through Appeal — Section 14(2) Does Not Bar Her Right

4–5 Line Crux of the Judgment:

The Lahore High Court held that although Section 14(2) of the Family Courts Act, 1964 bars a husband from appealing against a decree for dissolution of marriage, it does not prevent a wife from challenging the conditions attached to such decree. The petitioner sought conversion of a Khula decree into a decree of dissolution based on cruelty. The Court ruled that such relief could be sought through a regular family appeal before the Appellate Court. Consequently, the constitutional petition was disposed of as premature with liberty to avail the statutory remedy of appeal.

پشاور ہائیکورٹ نے مقدمہ نمبری1160-P/2023 میںخیبر پختونخوا میں اسلحہ لائسنس کے اجرا اور تجدید کی فیسوں میں اضافے کے خلاف دائر تمام درخواستیں مسترد کر دیں۔
جسٹس اعجاز انور اور جسٹس انعام اللہ خان پر مشتمل ڈویژن بنچ نے 34 صفحات پر مشتمل تحریری فیصلہ جاری کیا، جس میں عدالت نے قرار دیا کہ حکومتی پالیسی کے معاملات میں تب تک مداخلت نہیں کی جا سکتی جب تک کوئی غیر قانونی شق یا بنیادی حقوق کی پامالی ثابت نہ ہو۔ خیبر پختونخوا رائفل ایسوسی ایشن سمیت دیگر درخواست گزاروں نے استدعا کی تھی کہ اسلحہ لائسنس فیس میں 100 فیصد سے زائد اضافہ غیر قانونی اور عوامی فلاح کے برعکس ریونیو اکٹھا کرنے کا ذریعہ ہے۔ تاہم، ایڈیشنل ایڈوکیٹ جنرل تیمور خان نے عدالت کو بتایا کہ کے پی آرمز ایکٹ 2013 اور رولز 2014 کے تحت حکومت کو فیسوں کے تعین کا قانونی اختیار حاصل ہے اور یہ فیصلہ کابینہ کی منظوری سے کیا گیا۔ عدالت نے اپنے ریمارکس میں کہا کہ صوبے میں 85 سے 92 فیصد پرتشدد جرائم میں اسلحہ کا استعمال ہوتا ہے، اس لیے لائسنسنگ کے عمل کو مزید سخت کیا جائے تاکہ معاشرے کو اسلحہ کے بے جا استعمال سے محفوظ رکھا جا سکے۔ عدالت نے واضح کیا کہ عدلیہ پالیسی سازی میں انتظامیہ کے متبادل کے طور پر کام نہیں کر سکتی۔

The Lahore High Court, Rawalpindi Bench, upheld the appointment of a mother as guardian of her mentally ill son suffering from schizophrenia. The Court relied upon the Medical Board's report confirming his inability to manage personal affairs independently. Since the mother had been the primary caregiver and no contrary medical evidence was produced, the father's appeal was dismissed. The Court emphasized that the welfare of the mentally incapacitated person is the foremost consideration.
