Criminal Miscellaneous Application 22-A Dismissed

In a recent judgment delivered by the Honorable IV Additional Sessions Judge, South Karachi, our client achieved a significant legal success in proceedings under Sections 22-A and 22-B Cr.P.C.

The applicant had sought directions for registration of an FIR and legal protection arising out of a property-related dispute. Our legal team successfully demonstrated that:

The applicant was not the direct aggrieved party and failed to produce any valid document establishing his legal authority.

The dispute was civil in nature, concerning ownership and possession, and was already pending before a competent civil court.

The inquiry revealed no criminal incident, and the allegations of threats were vague, lacking specific details or corroboration.

The Honorable Court held that jurisdiction under Sections 22-A and 22-B Cr.P.C. cannot be invoked as a substitute for civil proceedings, and that registration of an FIR is unwarranted where no cognizable offence exists.

After considering the record and submissions, the Court dismissed the application, observing that no reasonable grounds existed for recording a statement under Section 154 Cr.P.C.

Appeal Dismissed – Suit Declared Not Maintainable

In a recent judgment delivered by the Honorable VII Additional District Judge, South at Karachi, our clients — Respondents No. 1 & 2 — achieved a significant legal victory in Civil Appeal of 2025.

The appellant had challenged an earlier order passed under Order VII Rule 11 CPC, wherein the Trial Court rightly rejected a plaint seeking declaration, possession, and cancellation of property under the guise of benami ownership. Our legal team successfully demonstrated that:

The appellant lacked legal standing, as the suit was filed in the name of a deceased individual without lawful representation.

The claim was barred by law and lacked any actionable cause — rendering the plaint inherently non-maintainable.

The properties in question had already devolved legally and were not available for partition or challenge through benami claims.

The proper remedy, if any, lay in alternate legal forums such as under the Mental Health Ordinance, not through a flawed civil suit.

By referencing landmark case law including 2016 YLR 890, 2023 PLD 555, and 2022 PLD 66, we established that courts must not admit suits filed without proper legal character or jurisdiction.

After carefully considering our submissions, the Honorable Court dismissed the appeal and upheld the rejection of plaint, observing that no sustainable cause of action existed. The suit and any miscellaneous applications were disposed of accordingly.
