IP TRIBUNAL’S ORDER GRANTING INJUNCTION CHALLENGED IN APPEAL BEFORE HIGH COURT, LAHORE

The Petitioner challenged a Tribunal order that granted exclusive trademark use of Riaz & Sons to the Respondents. Both parties were undisputed partners and had pending applications for trademark registration.
The Court held that the firm, not individuals, owned the trademark and the partnership was not dissolved. The appeal was allowed, setting aside the Tribunal's order as unjust.

REGISTRATION OF TRADE MARK - APPEAL BEFORE SINDH HIGH COURT

The dispute revolved around the trademark “GLITZ”, whose registration was opposed by the Appellant, owner of the well-known mark “GETZ”. The Appellant argued that “GLITZ” was deceptively similar to its registered trademark and likely to cause confusion among consumers. However, the Registrar disallowed the opposition and permitted the “GLITZ” application to proceed. Respondent No. 2 defended the decision, claiming both marks differed in design and had been used independently since 2005. The Court, however, found that the Registrar had overlooked key facts and that the marks were indeed deceptively similar. Consequently, the appeal was allowed, and Respondent No. 2 was given six months to adopt a different trade name.

JUDGMENT OF THE REGISTRAR OF TRADE MARKS APPEALED BEFORE THE SINDH HIGH COURT, KARACHI, PAKISTAN

The Sindh High Court dismissed the appeal filed by Abdul Wasim against the refusal of his trade mark "NBN," citing its similarity to the well-known trade mark "NTN" of the Respondents. The Court held that "NTN" is protected under Section 86 of the Trade Marks Ordinance, 2001, due to its global recognition and prior use. It found that "NBN" was adopted with knowledge of "NTN"'s goodwill and failed the standard similarity tests. No illegality or error was found in the Registrar’s decision.

M/s Reckitt Benckiser Pakistan Ltd. filed a complaint against M/s Unilever Pakistan Ltd. before the Competition Commission of Pakistan, alleging deceptive marketing of Lifebuoy products through exaggerated and misleading claims such as “100% Proven Germ Protection” amongst others. The Commission found these claims scientifically untenable and lacking clear disclaimers, violating sections 10(2)(a) and (b) of the Competition Act. Unilever was held to have intentionally misled consumers and harmed competitors’ interests. A penalty of Rs. 60 million was imposed, with a 30-day compliance deadline and an additional Rs. 500,000 daily fine for continued violations. The show cause notice was accordingly disposed of.

Bharucha & Co. is a one stop solution for all Intellectual Property matters and issues. The firm has a long history going back to 1948 when it was established by its founder Mr. Abdur Rehman Bharucha (1909 – 2001) upon his migration from India after independence of Pakistan in August 1947. Thus it is one of the oldest firms of Pakistan in this profession. Since establishing the firm Mr. Abdur Rehman Bharucha was always conscious of the clients’ needs and strived hard to secure the interests of all clients of the firm. Due to the efforts of its founder the firm very soon acquired acclaim internationally to become one of the leading Intellectual Property firms in Pakistan which status it has still maintained. Also since its inception the firm has been catering to the needs of several multinational clients. The firm is a mix of old experienced hands together with members having experience of several decades as well as ever increasing fresh blood. The firm is fortunate that persons having experience since its inception are still available to shed their wisdom whenever needed as well as officers of the IP offices in Pakistan are also among the members of the firm since their retirements.
