میں کسی کی نوکری نہیں کرتا، میں ایک وکیل ہوں

یہ جملہ بظاہر ضد یا انا کا اظہار لگتا ہے، مگر دراصل یہ ایک سوچ، ایک فلسفہ اور ایک طرزِ زندگی کی نمائندگی کرتا ہے۔
میں کسی کی نوکری نہیں کرتا، کیونکہ میں ایک وکیل ہوں اور وکالت محض پیشہ نہیں، بلکہ آزادی کا اعلان ہے۔

وکالت ایک ایسا پیشہ ہے جہاں انسان اپنی محنت، علم اور کردار کے بل بوتے پر کھڑا ہوتا ہے۔ یہاں کسی کا ماتحت ہونا لازم نہیں، بلکہ ہر وکیل اپنی صلاحیتوں کا خود ذمہ دار ہے۔ کوئی باس نہیں، کوئی حکم نہیں صرف قانون کی بالادستی اور انصاف کا تقاضا۔
یہی وہ مقام ہے جہاں ایک شخص اپنی عزت خود بناتا ہے، اپنی پہچان خود تخلیق کرتا ہے، اور اپنے ضمیر کے سامنے جواب دہ رہتا ہے۔

وکالت اختیار کرنے کا فیصلہ آسان نہیں ہوتا۔ یہ راستہ آسان کم، باوقار زیادہ ہے۔ میں نے یہ پیشہ اس لیے نہیں چُنا کہ عدالتوں کے چکر لگانے کا شوق تھا، بلکہ اس لیے کہ میں اپنی محنت کا مالک بنوں، اپنی عزت خود کماؤں، اور کسی کے زیرِ حکم نہیں بلکہ قانون کے تابع رہوں۔
ایک وکیل کا سرمایہ اس کا علم ہے، اس کا ہتھیار اس کی زبان، اور اس کا وقار اس کی ساکھ۔ یہ پیشہ ان لوگوں کے لیے ہے جو سچ کے لیے کھڑے رہتے ہیں، چاہے ہوا مخالف ہی کیوں نہ چلے۔

اکثر لوگ حیرت سے پوچھتے ہیں، “آپ تو کسی کے ماتحت نہیں، کیا یہ مشکل نہیں ہوتا خود پر پورا بوجھ اٹھانا؟”
میں ہمیشہ مسکرا کر جواب دیتا ہوں، “ہاں، مشکل تو ہے مگر غلامی سے بہتر ہے کہ انسان اپنی مشکل خود اٹھائے۔”
نوکری میں شاید سکون ہو، مگر وکالت میں عزت ہے، اور میرے لیے عزت ہمیشہ سکون سے زیادہ قیمتی رہی ہے۔

وکالت کا ہر دن ایک امتحان ہوتا ہے۔ ہر مقدمہ ایک نیا چیلنج، ہر عدالت ایک نیا معرکہ۔ یہاں کوئی شارٹ کٹ نہیں، کامیابی کا راستہ صرف محنت اور استقامت سے گزرتا ہے۔ لیکن جب کامیابی ملتی ہے تو وہ دیرپا ہوتی ہے، کیونکہ وہ کسی سفارش نہیں بلکہ اپنے خونِ جگر سے حاصل کی جاتی ہے۔

ایک وکیل صرف قانونی نمائندہ نہیں، بلکہ معاشرتی توازن کا محافظ ہوتا ہے۔ وہ ان مظلوموں کی آواز بنتا ہے جنہیں سننے والا کوئی نہیں، ان کمزوروں کے لیے ڈھال بنتا ہے جن پر نظام کا بوجھ ٹوٹتا ہے۔
میں جب عدالت میں کھڑا ہوتا ہوں، تو مجھے محسوس ہوتا ہے کہ میں کسی کے لیے مقدمہ نہیں لڑ رہا بلکہ انصاف کے ایک اصول کی حفاظت کر رہا ہوں۔

وکالت میں کبھی راتیں جاگتی ہیں، کبھی دن فیصلے کے انتظار میں گزرتے ہیں۔ مگر یہ پیشہ اپنے اندر ایک عجیب شان رکھتا ہے۔ یہاں انسان خود اپنی دنیا بناتا ہے، خود اپنے فیصلے کرتا ہے، اور اپنی کامیابی خود لکھتا ہے۔

میں کسی دفتر کی گھڑی کے تابع نہیں، نہ کسی مالک کے موڈ کے۔
میرا وقت، میرا قلم، اور میری زبان یہ سب میرے اپنے ہیں۔
اور یہی میرا وقار ہے، یہی میری آزادی ہے۔

آخر میں صرف اتنا کہوں گا کہ وکالت ایک پیشہ نہیں بلکہ ایک نظریہ ہے، یہ ان لوگوں کا راستہ ہے جو سمجھوتہ نہیں کرتے، جو سچ کے ساتھ کھڑے رہنے کی جُرأت رکھتے ہیں، چاہے اس کی قیمت اپنی آسانی، اپنا آرام یا اپنی مقبولیت ہی کیوں نہ ہو۔

میں کسی کی نوکری نہیں کرتا کیونکہ میں آزاد ہوں، خود مختار ہوں، اور میں ایک وکیل ہوں۔

KARACHI: The Sindh High Court has suspended the operation of the Customs Appellate Tribunal’s judgment dated March 14, 2024, passed in Customs Appeal No. K-1599/2022, while admitting Special Customs Reference Application No. 464 of 2024 for hearing.

The Court observed that the impugned judgment was devoid of independent reasoning or deliberation and could not be considered a speaking order. It was further contended by the learned counsel that the Tribunal had rendered its findings in a perfunctory manner, which was not befitting the last fact-finding forum under the statutory hierarchy.

The High Court accordingly admitted the reference, issued notices to the respondents.

KARACHI: The Sindh High Court has suspended the operation of the Customs Appellate Tribunal’s judgment dated July 16, 2025, in Customs Appeal No. K-720/2025, while admitting Special Customs Reference Application No. 179 of 2025 for hearing.

The Court noted that the case involved alleged smuggling of goods in a vehicle and that the Tribunal allowed the respondent’s appeal despite his non-appearance in adjudication. It was argued that even if a prima facie case existed, the matter should have been remanded to the adjudicating authority rather than relief being granted outright.

KARACHI: The Sindh High Court has dismissed a constitutional petition filed by M/s Rajby Textiles challenging the order of the Sindh Labour Appellate Tribunal, which had awarded compensation of Rs.300,000/- to a former employee, Muhammad Saeed alias Saeed Khan, in lieu of reinstatement.

The Court held that the petitioner failed to establish its claim of being a trans-provincial entity, observing that employment within Karachi brought the matter squarely within the jurisdiction of the provincial Labour Court. It further found that the respondent, though initially hired through a labour supplier, was performing core production duties under the direct supervision and control of the petitioner, thereby establishing a clear relationship of employer and employee.

Dismissing the petition, the bench comprising Justice Muhammad Iqbal Kalhoro and Justice Muhammad Abdur Rehman upheld the Tribunal’s decision and directed that the deposited compensation amount, along with any accrued profits, be released to the respondent after due verification.

KARACHI: The Sindh High Court has suspended the operation of the Customs Appellate Tribunal’s order in a case relating to the assessment of imported goods under Section 25 of the Customs Act, 1969.

The dispute arose when the Tribunal directed the Customs Department to determine the assessable value of goods on the basis of transaction value, holding that the Valuation Ruling (VR) was outdated. The Department, however, contended that under Section 25A(4) of the Act, a Valuation Ruling remains operative and binding unless revised or rescinded.

During the hearing, Advocate Khalilullah Jakhro appearing for the applicant (Customs Department), argued that the Tribunal’s reliance on an earlier judgment reported as 2007 PTD 2623 was misplaced since the law had been subsequently amended to clarify the continued applicability of Valuation Rulings.

Admitting the reference, the High Court issued notice to the respondent and suspended the operation of the impugned Tribunal order dated 12.11.2024 passed in Customs Appeal No. K-2579/2024. The matter will be heard on 23.10.2025 along with connected references SCRA Nos. 383 to 385 of 2024.

KARACHI: The Sindh High Court has suspended the order of the Appellate Tribunal Inland Revenue (ATIR) in a sales tax matter involving M/s Bulleh Shah. The impugned order dated January 5, 2023, passed in STA No. 472/KB-2016, had set aside the departmental assessment made under Section 11(1) of the Sales Tax Act, 1990.
