Classes of FIR (First Information Report) with Case Law
FIRs are classified into three categories in Pakistan:
1️⃣ "A" Class FIR – The case is genuine, but the accused is unknown or cannot be traced. If no evidence is found, the Magistrate can close the case until the accused is identified.
📌 Case Law: State vs. Bashir Ahmed (PLD 1997 SC 408) – An "A" Class FIR can be reopened if new evidence emerges.
2️⃣ "B" Class FIR – The case is false or baseless. If there is no proof against the accused and the FIR was filed with bad intent, the police submit a 'B' Class report. The court may also order action against the complainant under Section 182 PPC.
📌 Case Law: Muhammad Bashir vs. SHO (PLD 2007 SC 539) – The Supreme Court ruled that if an FIR is found to be false, legal action can be taken against the complainant.
3️⃣ "C" Class FIR – The case involves a non-cognizable offense or a civil dispute. If the complaint was made by mistake or does not involve a criminal offense, the police file a 'C' Class report. The Magistrate may seek a separate report under Section 155 Cr.P.C.
📌 Case Law: Abdul Rehman vs. The State (2011 SCMR 1332) – The court held that a "C" Class FIR should be closed if the matter is of civil nature or lacks criminal intent.
