Procedure of Filing Trademark Application:
Step 1: Preliminary search
Before filling a trademark application, the first step is to see whether the desirable trademark have been registered or is in use by any other person in Pakistan.
Step 2: Filing the Application
Once the search is clear of any objection, the registration process is initiated by submitting a filled application to the IPO-Pakistan containing all particulars of the mark and the class of goods and services in which it is to be registered.
Step 3: Examination Report
IPO-Pakistan will examine the trademark application to ensure it complies with the requirements of the law. Examination Report is generated after 3 months of filing an application and any objections are informed to the Applicant via a Show Cause Notice. The applicant is required to submit a reply within two months from the date of issuance of a Show Cause Notice.
Step 4: Publication
If the application is accepted by the IPO-Pakistan, your trademark will be published in the official Trademarks Journal. This allows third parties to oppose to your registration within a time frame of three months.
Step 5: Third Party Opposition
If a third-party files an opposition to the applied trademark, the case is referred to the Opposition Section for hearing on the opposition by the Registrar Trademarks, IPO-Pakistan.
Step 6: Grant of Certificate
The IPO-Pakistan will issue a trademark registration certificate if there are no oppositions or when any disputes are resolved in your favour, whichever is the case. A registration certificate is issued evidencing that the trademark is registered from the date of filing.
