کسٹڈی کے کیس میں اگر 8 سال کا بچہ جج کے سامنے بیان دے کہ وہ اپنے والد اور دادی کے ساتھ رہنا چاہتا ہے تو عدالت بچے کی فلاح اور بھلائی کو مدنظر رکھتی ہے۔ پاکستانی فیملی لا کے تحت کم عمر بچوں کی حضانت عموماً ماں کو دی جاتی ہے، لیکن اگر بچہ سمجھ بوجھ کی عمر میں ہو اور اپنی مرضی ظاہر کرے تو عدالت اس بیان کو سنجیدگی سے لیتی ہے۔ اگر یہ محسوس ہو کہ بچے کے بہترین مفاد میں باپ کے پاس رہنا بہتر ہے تو عدالت باپ کو کسٹڈی دے سکتی ہے، جبکہ ماں کو ملاقات کا حق دیا جاتا ہے۔ ہر کیس میں والدین کی صلاحیت، ماحول اور بچے کی فلاح کو دیکھ کر فیصلہ کیا جاتا ہے۔
In a custody case, if an 8-year-old child tells the judge that he wants to live with his father and grandmother, the court considers the welfare and best interest of the child. Under Pakistani family law, custody of young children is usually granted to the mother, but if the child is of an age to understand and expresses a clear preference, the court takes it seriously. If it is deemed in the child's best interest to live with the father, the court may grant custody to the father while giving the mother visitation rights. Decisions are based on parents’ capabilities, the environment, and the child’s overall well-being.
