ANOTHER MAJOR LEGAL VICTORY AT THE APPELLATE BENCH! ⚖️🏛️
Justice prevailed today before the Model Civil Appellate Court (XIIIth Additional District Judge, Karachi South) in First Rent Appeal No. 266 of 2025 (Jameel vs. Abdul Shakoor).
The Appellant was facing an illegal eviction order despite being the legitimate, lawful owner in possession of his property through a registered Sub-Lease executed over a decade ago. The trial court had erroneously held him to be a defaulting tenant on mere assumptions without any proof of a landlord-tenant relationship.
Key Legal Breakthroughs Achieved:
Demolished the Alleged Tenancy: Exposed critical admissions during cross-examination where the opposing party admitted to having no written tenancy agreement, no rent receipts, and no evidence of any oral tenancy agreement.
Protected Registered Title: Established that an un-cancelled, registered Sub-Lease carries a presumption of validity under the law that cannot be ignored or bypassed in summary rent proceedings.
Jurisdictional Mastery: Successfully argued that the Rent Controller lacks jurisdiction to decide complex questions of disputed title where no landlord-tenant relationship exists (PLD 1961 Lah. 60 & 2001 SCMR 1434).
The Verdict:
The Appellate Court accepted our arguments in full, ALLOWED the First Rent Appeal, and SET ASIDE the impugned trial court order dated 31-10-2025!

We are pleased to share that a favourable order has been secured for our client,
The bail application in Special Case No. 3256/2023 was filed by Muhammad Sabir and Asmatullah, accused in FIR No. 383/2022 under Sections 6/9-C of the CNS Act.
The court granted post-arrest bail to the applicants/accused on 23.08.2023, subject to furnishing solvent surety of Rs. 1,00,000 each and a P.R. bond of the same amount. The decision was based on the grounds that the alleged offence did not fall under the prohibitory clause of the Narcotics Act (section 497 Cr.P.C.), the prosecution lacked sufficient evidence, and the accused had no prior criminal record and had been in custody for almost a year without trial completion.
