USCIS to Consider Anti-Americanism in Immigrant Benefit Requests

WASHINGTON – U.S. Citizenship and Immigration Services is updating guidance in the USCIS Policy Manual regarding the factors that officers consider in certain benefit requests where an exercise of discretion is required, including factors relating to aliens’ past requests for parole and any involvement in anti-American or terrorist organizations, as well as the use of discretion in adjudication of certain benefit requests where evidence of antisemitic activity is present.

Separately, USCIS has expanded the types of benefit requests that receive social media vetting, and reviews for anti-American activity will be added to that vetting. Anti-American activity will be an overwhelmingly negative factor in any discretionary analysis.

“America’s benefits should not be given to those who despise the country and promote anti-American ideologies. U.S. Citizenship and Immigration Services is committed to implementing policies and procedures that root out anti-Americanism and supporting the enforcement of rigorous screening and vetting measures to the fullest extent possible,” said USCIS spokesman Matthew Tragesser. “Immigration benefits—including to live and work in the United States—remain a privilege, not a right.

USCIS is reiterating its guidance that an alien’s compliance with immigration laws is a relevant factor when determining if a favorable exercise of discretion is warranted and updating the Policy Manual to provide additional guidance in circumstances where an alien has endorsed, promoted, supported, or otherwise espoused the views of a terrorist organization or group, including aliens who support or promote anti-American ideologies or activities, antisemitic terrorism and antisemitic terrorist organizations, or who promote antisemitic ideologies. When conducting a discretionary analysis, USCIS officers will consider whether an alien’s application for admission or parole was made in accordance with all applicable laws, regulations, and policies in effect at the time.

This update will also clarify how an exercise of discretion is applied when adjudicating an EB-5 investor petition or application in cases involving threats to the national interest, fraud, deceit, misrepresentation, and criminal misuse.

This guidance, contained in Volume 1 of the Policy Manual, is effective immediately and applies to requests pending or filed on or after the publication date. The guidance contained in the Policy Manual is controlling and supersedes any related prior guidance.

Interview Waiver Update July 25, 2025

Effective September 2, 2025, the Department of State will update the categories of applicants that may be eligible for a waiver of the nonimmigrant visa interview. All nonimmigrant visa applicants, including applicants under the age of 14 and over the age of 79, will generally require an in-person interview with a consular officer except:

Applicants classifiable under the visa symbols A-1, A-2, C-3 (except attendants, servants, or personal employees of accredited officials), G-1, G-2, G-3, G-4, NATO-1 through NATO-6, or TECRO E-1;
Applicants for diplomatic- or official-type visas; and
Applicants renewing a full validity B-1, B-2, B1/B2 visa or a Border Crossing Card/Foil (for Mexican nationals) within 12 months of the prior visa’s expiration, and who were at least 18 years old at the time of the prior visa’s issuance.
To be eligible for an interview waiver based on the third bullet point above (applicants renewing a full validity B-1, B-2, B1/B2 visa or a Border Crossing Card/Foil for Mexican nationals), applicants must also meet certain criteria, including that they:

apply in their country of nationality or residence;
have never been refused a visa (unless such refusal was overcome or waived); and
have no apparent or potential ineligibility.
Consular officers may still require in-person interviews on a case-by-case basis for any reason. Applicants should check embassy and consulate websites for more detailed information about visa application requirements and procedures, and to learn more about the embassy or consulate’s operating status and services.

This supersedes the Interview Waiver Update of February 18, 2025.

WASHINGTON— U.S. Citizenship and Immigration Services is updating the USCIS Policy Manual to clarify that it only recognizes two biological s*xes, male and female.

Consistent with the Jan. 20, 2025, executive order, Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government, USCIS is returning to its historical policy of recognizing two biological s*xes.

“There are only two s*xes — male and female,” said DHS Assistant Secretary for Public Affairs Tricia McLaughlin. “President Trump promised the American people a revolution of common sense, and that includes making sure that the policy of the U.S. government agrees with simple biological reality. Proper management of our immigration system is a matter of national security, not a place to promote and coddle an ideology that permanently harms children and robs real women of their dignity, safety, and well-being.”

Under this guidance, USCIS considers a person’s s*x as that which is generally evidenced on the birth certificate issued at or nearest to the time of birth. If the birth certificate issued at or nearest to the time of birth indicates a s*x other than male or female, USCIS will base the determination of s*x on secondary evidence. See Volume 1, General Policies and Procedures, Part E, Adjudications, Chapter 6, Evidence, Section B, Primary and Secondary Evidence [1 USCIS-PM E.6(B)].

USCIS will not deny benefits solely because the benefit requestor did not properly indicate his or her s*x. However, USCIS does not issue documents with a blank s*x field, and does not issue documents with a s*x different than the s*x as generally evidenced on a birth certificate issued at the time of birth (or issued nearest to the time of birth). Therefore, if a benefit requestor does not indicate his or her s*x or indicates a s*x different from the s*x on his or her birth certificate issued at the time of birth (or issued nearest to the time of birth), there may be delays in adjudication.

USCIS may provide notice to benefit requestors if it issues a USCIS document reflecting a s*x different than that indicated by the benefit requestor on the request.

This guidance, contained in Volumes 1, 11, and 12 of the Policy Manual, is effective immediately and applies to benefit requests pending or filed on or after April 2, 2025. The guidance contained in the Policy Manual is controlling and supersedes any related prior guidance.
