"Maritime Arbitration Forums"
A lecture by Nisar A. Mujahid Advocate Supreme Court of Pakistan
Nisar A. Mujahid is a renowned expert in maritime law and arbitration. In his lecture on "International Maritime Arbitration Forums", he discussed the various forums that exist for resolving maritime disputes through arbitration.
Mujahid started by explaining the importance of arbitration in the maritime industry, given the complex and often cross-border nature of maritime disputes. He then went on to discuss the different arbitration forums that exist, including the International Chamber of Commerce (ICC), the London Maritime Arbitrators Association (LMAA), and the Society of Maritime Arbitrators (SMA) in New York.
Mujahid explained that the ICC is the most widely recognized international arbitration forum, and it has a dedicated maritime arbitration commission. The LMAA, on the other hand, is a non-profit organization based in London that specializes in maritime arbitration. The LMAA is known for its quick and efficient dispute resolution process. The SMA is based in New York and is one of the oldest and most respected maritime arbitration forums in the world.
Mujahid also discussed the differences between ad hoc and institutional arbitration, and the advantages and disadvantages of each. He emphasized that institutional arbitration, where the arbitration is administered by an established organization such as the ICC, can provide a more efficient and reliable process than ad hoc arbitration, which is not administered by any organization.
In conclusion, Mujahid stressed the importance of choosing the right arbitration forum for a particular dispute, taking into account the nature of the dispute, the parties involved, and other relevant factors. He also highlighted the need for parties to carefully consider the choice of law and venue for their arbitration agreement, as these factors can greatly impact the outcome of the dispute resolution process.
