The authority to hear appeals against the High Courts’ decisions regarding bail in NAB cases lies with the Federal Constitutional Court, not with the Supreme Court.

Therefore, all pending NAB case appeals in the Supreme Court should be immediately transferred to the Federal Constitutional Court.

A three-member bench headed by Supreme Court Justice Muhammad Ali Mazhar issued the decision.

Azka Wahid v Province of Punjab (2024 LHC 1392) .

The case Azka Wahid v Province of Punjab (2024 LHC 1392) is a landmark judgment
delivered by the Lahore High Court concerning gender equality in marriage laws.
The petitioner, Barrister Azka Wahid, filed a constitutional petition challenging
Section 2(a) of the Child Marriage Restraint Act (CMRA) 1929 (as amended in 2015), which defined a "child" as a male under 18 years and a female under 16 years.

The petition argued that this age gap constituted gender-based discrimination, violating Article 25 of the Constitution (which guarantees equality before the law)
and Article 35 (which mandates the State to protect the family, mother, and child).
On March 7, 2024, the court declared the discriminatory age threshold
unconstitutional and struck down the phrase "and if a female is under sixteen years
of age," effectively mandating a uniform minimum age of 18 for both genders and
directed the Government of Punjab to issue a revised version of the Act within 15
days .

The plaintiff filed a suit for restitution of conjugal rights after his wife refused to live
with him, claiming he had not paid her dower.The wife had previously lived with the
husband for three months and consummated the marriage without making a
demand for the dower payment.

Justice Syed Mahmood authored the judgment, ruling that marriage in Islam is a civil
contract rather than a sacrament.The court defined dower as consideration for the
marriage and held that a wife's right to refuse cohabitation is lost once the marriage
is voluntarily consummated. The final decision allowed the husband's claim for restitution of conjugal rights but
maintained that the wife still had the legal right to sue separately for the payment of
her dower.
