PLD 2025 FSC 1
A highly significant judgment delivered by the Federal Shariat Court of Pakistan has categorically declared that depriving women of their inheritance, under any custom, jirga decision, “Chadar,” “Parchi,” or “Haq Bakhshwana,” is un-Islamic, unlawful, and void.
The Court held that, under the injunctions of the Qur’an and Sunnah, a woman’s right to inheritance is a mandatory and enforceable right which cannot be extinguished through social customs, family pressure, or informal arrangements.
The judgment also emphasized Section 498-A of the Pakistan Penal Code, under which depriving a woman of her inheritance through fraud, coercion, or any illegal means constitutes a serious criminal offence punishable with imprisonment of up to ten years.
This landmark ruling is not only a major step toward safeguarding women’s rights but also sends a strong judicial message against a deeply rooted social evil in society.

وفاقی شرعی عدالت پاکستان کا یہ نہایت اہم فیصلہ قرار دیتا ہے کہ خواتین کو وراثت سے محروم کرنا، خواہ کسی بھی رسم، جرگہ، “چادر”، “پرچی” یا “حق بخشوانہ” کے نام پر ہو، غیر اسلامی، غیر قانونی اور کالعدم ہے۔
عدالت نے واضح کیا کہ قرآن و سنت کی روشنی میں خواتین کا حقِ وراثت ایک لازمی اور قابلِ نفاذ حق ہے جسے کسی بھی سماجی روایت، خاندانی دباؤ یا غیر رسمی بندوبست کے ذریعے ختم نہیں کیا جا سکتا۔
فیصلے میں تعزیراتِ پاکستان کی دفعہ 498-A پر بھی زور دیا گیا، جس کے مطابق کسی عورت کو دھوکے، جبر یا کسی بھی غیر قانونی طریقے سے وراثت سے محروم کرنا ایک سنگین فوجداری جرم ہے جس کی سزا دس سال تک قید ہو سکتی ہے۔
یہ فیصلہ نہ صرف خواتین کے حقوق کے تحفظ کی جانب ایک اہم پیش رفت ہے بلکہ معاشرے میں موجود اس دیرینہ سماجی برائی کے خلاف ایک مضبوط عدالتی
