PLD 2026 Lahore 649
PLJ 2026 Cr.C. 191
Courts can only exercise jurisdiction vested in them by the Constitution or law made thereunder; trial of offence of "polygamy" can only be conducted by the Family Courts established under the Family Court Act 1964 (FCA) and appeals arising therefrom are to be adjudicated by the District Court in terms of Section 14 of FCA. Consequently, the Court of Sessions lacked jurisdiction to adjudicate on the appeal for want of jurisdiction, because the correct forum for filing an appeal against the decision of the trial court pertaining to the offence of "polygamy" is the District Court, not the Court of Sessions.

Ali Shahzad alias Shan Ali Vs The State etc
Mere presence of prosecution witnesses in Court, without recording of their evidence and without a specific order-sheet explanation as to why such evidence could not be recorded, is insufficient to deprive the petitioner of his statutory right.

MUHAMMAD BOOTA & ANOTHER VS. THE STATE
1984 SCMR 560
It is held that a witness is not necessarily hostile merely because he gives evidence unfavorable to the party calling him. A hostile witness is one who, from the manner of giving evidence, appears unwilling to tell the truth or whose answers deliberately conflict with the material evidence in the case.

2017 SCMR-283
Even where no proper investigation is conducted, but where the material that comes before the Court is sufficient to connect the accused with the commission of crime, the accused can still be convicted, notwithstanding minor omissions that have no bearing on the outcome of the case.

PLD 2026 ISLAMABAD 63
Collection and preservation of data/evidence relating to the commission of offences under the 2016-Act is different from freezing of the properties i.e. Bank accounts of persons, for which express sanction of the Legislature in the parent statute i.e. 2016-Act is required. There is plethora of judgments that subordinate legislation shall neither be in conflict with the provisions of parent statute nor travel beyond its permissible scope and that the rule taking authority shall not act as Majlis-e-Shoora(Parliament) to assume powers not delegated by the parent law. Rule 5 of the Rules thus appears to have been framed in excess of the powers delegated by sections 27, 28 and 51 of the 2016-Act.

MUHAMMAD SHAKEEL VS
STATE ETC
Mr. Justice Khalid Ibn-i-Aziz
25-08-2026
The punishment provided for the offence under Section 322 PPC is only Diyat. Although the offence under Section 322 PPC is non-bailable yet no punishment of imprisonment is provided for the said offence. If, an accused charged under Section 322 PPC, upon pleading his guilty or after his trial is convicted, he can only be kept in confinement in case he commits default in the payment of Diyat amount, at moment, incarceration of the petitioner pending trial would amount to double jeopardy and it is settled law that where the criminal liability of an offence is Diyat only, that offence does not fall within the prohibitory clause and where an offence does not fall within the prohibitory clause, the acceptance of bail is the rule and the rejection is an exception.

Umar Farooq Vs The State etc.
Doubtful medical evidence regarding the alleged finger fracture, allegedly caused without any corresponding injury to the remaining part of the hand, prima facie suggests a friendly-handed occurrence, thereby making out a case for the extraordinary concession of pre-arrest bail.

PLD 2026 SC 380
A person who was not a party to the proceedings below may be granted leave to appeal only if he could properly have been impleaded therein; but a pendente lite transferee who acquires the suit property without seeking leave under Section 52 of the Transfer of Property Act, 1882, conceals the transfer from the Court, and delays seeking impleadment or filing suit for specific performance until it is barred under Article 113 of the Limitation Act, 1908, cannot be regarded as a bona fide purchaser or a necessary/proper party, and is therefore disentitled to leave to appeal.
