Cancellation_of_Bail – Section 497(5) Cr.P.C
Apart from the merits of the case, it may be observed that the
considerations for cancellation of Bail are different from the grounds for grant of Bail & the Bail granted by a Court of competent jurisdiction can only be cancelled in exceptional circumstances, which may be summarized as under:
(i) if the Bail granting order has been passed in capricious manner either without assigning reasons, or on the basis of perverse or invalid reasons;
(ii) if the mulzim attempts to tamper with the evidence or if he hampers the investigation;
(iii) if the mulzim commits or attempts to commit same offence;
(iv) if the mulzim absconds after grant of bail;
(v) if the Bail granting order is patently illegal, erroneous, factually incorrect & has resulted in miscarriage of justice;

آج کل رومانیہ، مالٹا، پرتگال، ہنگری، اٹلی اور یونان کے ورک ویزہ یا امیگریشن کے جھانسے میں بھی لوگوں کو لوٹا جا رہا ہے۔ جعلی آفر لیٹر، جعلی کمپنی کنٹریکٹ اور ’’ورک پرمٹ‘‘ کے نام پر لوگوں سے 10 سے 15 لاکھ روپے ایڈوانس وصول کیے جاتے ہیں۔ بعد میں پتہ چلتا ہے کہ وہ دستاویزات جعلی تھیں اور متعلقہ ملک کے سفارتخانے نے کبھی ایسا ویزہ جاری ہی نہیں کیا۔

خلیجی ممالک جیسے دبئی، قطر، بحرین اور سعودی عرب کے لئے بھی جعلی ویزہ آفرز عام ہیں۔ ایجنٹ روزگار کے نام پر ویزہ اور ٹکٹ پیکج بتاتے ہیں، لاکھوں روپے ایڈوانس لیتے ہیں اور بعد میں نہ ویزہ ملتا ہے نہ ٹکٹ۔ اسی طرح طالب علموں کو یوکے، آسٹریلیا اور یورپ میں اسٹڈی ویزہ کے خواب دکھا کر ان سے بھاری رقوم بٹوری جاتی ہیں جبکہ داخلہ لیٹر اور بینک اسٹیٹمنٹ سب جعلی نکلتے ہیں.

اسی طرح کینیڈا کے 10 سالہ وزٹ ویزہ کے نام پر ایجنٹ شہریوں سے بھاری رقوم وصول کر رہے ہیں۔ عام طریقہ واردات یہ ہے کہ ایجنٹ پانچ لاکھ روپے ایڈوانس وصول کرتا ہے اور کہتا ہے کہ پینسٹھ لاکھ روپے پاسپورٹ پر ویزہ لگنے کے بعد ادا کرنا ہوں گے۔ اگر ویزہ مسترد ہو جائے تو تین لاکھ روپے ’’پروسسنگ فیس‘‘ کے نام پر ہڑپ کر لیے جاتے ہیں اور صرف دو لاکھ روپے واپس کیے جاتے ہیں۔ بعض اوقات ایجنٹ اصل میں ویزہ کی کوئی درخواست جمع ہی نہیں کرواتے بلکہ کلائنٹ کو کئی ماہ تک دھوکے میں رکھتے ہیں اور آخرکار جھوٹ بول کر ریجیکشن کا بہانہ بنا دیتے ہیں ۔

ایف آئی اے کو شکایات

فیڈرل انویسٹی گیشن ایجنسی (FIA) کے پاس ایسے ویزہ فراڈ کے ہزاروں کیسز رپورٹ ہو چکے ہیں۔ زیادہ تر شکایات درج ذیل نوعیت کی ہوتی ہیں:

1. ایڈوانس رقم ہتھیانا: ایجنٹ ویزہ پراسیسنگ کے نام پر لاکھوں روپے ایڈوانس لیتے ہیں۔

2. جعلی ویزہ اور دستاویزات: جعلی ورک پرمٹ، آفر لیٹر اور اسٹڈی ایڈمیشن لیٹرز فراہم کیے جاتے ہیں۔

3. ایپلیکیشن جمع نہ کروانا: اکثر اوقات ایجنٹ سفارتخانے یا ایمبیسی میں درخواست جمع ہی نہیں کراتے۔

4. جزوی ریفنڈ کا فراڈ: ویزہ ریجیکشن کے بعد معمولی رقم واپس کر کے باقی ہڑپ کر لی جاتی ہے۔

5. جعلی کمپنیوں کا سہارا: بیرون ملک فرضی یا کاغذی کمپنیاں دکھا کر ورک ویزہ بیچا جاتا ہے۔

6. فوری ویزہ کا جھانسہ: ’’7 دن یا 15 دن میں ویزہ لگنے‘‘ کے پرکشش نعرے لگا کر عوام کو بہکایا جاتا ہے۔

یہ ایک سنگین فراڈ ہے
