It isn’t easy or let’s put it positively, it’s exciting but it can also be tiring when you’re on your own. Don’t get us wrong, we’re not saying it’s boring; it’s our passion. There’s nothing more exciting than building your own practice, creating something that is truly yours.

It may not be easy for young advocates. It takes time, and patience, but once it starts to fall into place, it’s all worth it.

The nerves that hit when you’re about to argue a contested case in the Court, the confusion when you’re drafting something on a completely new subject these are all part of the process. And honestly, who thought it would be this technical back in law college? Back then, it all seemed so effortless big firms, easy practice, constant wins.

But the reality is different. It’s trial and error. It’s countless trips to the second floor for updates, for copies, for follow-ups. And somehow, in all of this, you grow.

The Supreme Court of Pakistan, in PLD 2019 SC 218 (NCSW v. Government of Pakistan), categorically held that the jirga system is illegal and unconstitutional. The recent brutal murder of Sheetal Baloch and her husband Zarak, allegedly on the orders of a jirga, is a flagrant violation of the law and fundamental human rights. Honor killing is a dark stain on our society and must be eradicated through firm legal action and accountability.

How to Read Case Law - One of the most important skills;

Reading case law is different than reading anything else. You can't read it as if you are reading a research paper or a novel.

The first few times I read a case I had no idea what I was supposed to be doing. Now as a 3L, I have it down fairly well. I actually find it quite fun.

Here are the things you are looking for while reading a case:

1. The issue: The court may tell you directly what the issue is (I love when they do this). Oftentimes though you may have to reverse engineer the holding to figure out what the court was trying to answer. I'll discuss the holding later. Once you know the court's answer you can usually determine what question the court was trying to answer.

2. The Important Facts: What are the facts that the court discusses in their analysis? Those are the ones you want to pay attention to. The facts let you know the circumstances in which the rule from the case you are reading will be applied. Some facts are very specific to the case you are reading, those are less important.

3. Procedural History: What has happened so far to get us to this particular case. Most of the case law you read will be on appeal. Professors often ask about this during cold calls. Pay attention to what court you are in and what court the case came from. Also pay attention to who the lower court sided with.

4. The Rule: The court will usually cite to past precedent in this section. There will typically be many cases cited Be on appeal. Professors often ask about this during cold calls. 5. Analysis: This is where the court applies the rule to the facts of the particular case you are reading. Not everything here will be important, courts like to go back and forth in the analysis a lot. It does sometimes help to know what would have happened had the facts been different.

6. The Holding: What the court ultimately decides the answer is in this specific case. They can resolve a case in many different ways. It is important to note what they did in this particular instance.

ایسلام آباد ہائی کورٹ کا اہم فیصلہ کے مطابق لڑکی کی نکاح کے لئے کم سے کم عمر کی شرائط پر گہرائی سے غور کیا گیا۔ معاملے کی بنیادی حقائق میں یہ ہے کہ ایک لڑکی کے والد نے اپنی بیٹی کے اغواء کی شکایت کی جس کے بعد پیٹیشنر عبد الرزاق کو اغوا کرنے کے الزام میں گرفتار کیا گیا۔ عدالت میں اس معاملے پر بحث ہوئی کہ کیا لڑکی کی کم

عمر میں نکاح درست ہے یا نہیں۔

فیصلہ سننے والے جج نے مختلف فقہی اور قانونی دلائل کو مد نظر رکھتے ہوئے فیصلہ کیا۔ ان کے مطابق نکاح کے لئے کم سے کم عمر کا مسئلہ شرعی اور قانونی حدود کی روشنی میں دیکھا جائے۔

نکاح کرانا جرم قرار دیا گیا لیکن اگر لڑکی سولہ سال کی ہو اور سوئی

جیورس بھی ہو، تو وہ ولی کے بغیر نکاح کر سکتی ہے۔ فیصلے میں ایک

روشنی کا نقطہ یہ بھی رکھا گیا کہ حکومت کو نکاح کے لئے عمر کی

خصوصی حد مقرر کرنی چاہئے تاکہ کم عمری کی شادیوں کے نقصانات

کو روکا جا سکے۔

ایک نکاح کی تقریب ہے۔ حق مہر کے 5 سے 8 لاکھ مقرر کرنے کی بات ہو رہی ہے اور ساتھ 5 تولے سونا

سسر اپنے داماد کو ساتھ والی کرسی پر بلاتا ہے۔ سرگوشی میں پوچھتا ہے، بیٹا آپ کتنا مہر آسانی سے دے سکتے ہیں۔ داماد کہتا ہے آپ لوگ جو مقرر کریں منظور ہے لیکن میں اگر زیادہ کوشش کروں تو دو لاکھ دے سکتا ہوں۔ سسر نکاح خواں کو کہتا ہے مہر ایک لاکھ ہو گا

جب سسر نے سونے کے متعلق پوچھا تو داماد نے کہا میں دو
تولے بنا چکا ہوں تین اور بنا لوں گا۔ سسر نے سب کو مخاطب کر کے کہا کہ سونا دو تولے ہو گا

سب عزیز و اقارب ناراض ہوئے کہ اتنے کم مہر اور سونے پر آپ نے کیوں بات ختم کی
سسر نے کہا "آج اگر میں اس شخص کو جو بھی ڈیمانڈ کروں تو مجبوراً یہ پورا کرے گا۔ لیکن بعد میں یہ میری بیٹی کو جو پوری روٹی دے گا اس کو آدھی کر دے گا۔ وجہ یہ ہے کہ لوگوں سے قرضے لے کر یہ ڈیمانڈ پوری کر رہا گا

میں چاہتا ہوں کہ میری بیٹی بعد میں آرام اور خوشی سے رہے

اس شادی کے 15 سال ہو گئے۔ وہ داماد اپنی بیوی کا خیال رکھتا تھا اور سسر کی خود سے زیادہ عزت کرتا تھا۔ یہ کوئٹہ کا واقعہ ہے
