Art. 184(3)-Constitutional jurisdiction of the Supreme Private complaint/ grievance-Alternate remedy, availability by the applicant before the Supreme Court leveling serious allegations against the personnel of Inter Services Intelligence ('ISI') and Pakistan Rangers (Punjab) of misusing their office. and committing crimes against the applicant and his family.... Maintainability---Nature of a case filed under Article 184(3) of the Constitution is different from other cases, for a number of reasons---Firstly, the Supreme Court under Article 184(3) of the Constitution exercises original power, and whenever original power is exercised it must be done cautiously--- Secondly, where there exists other forum(s) to attend to the same it is best that they first do so---Thirdly, against the decision of a High Court appeals may come before the Supreme Court under Article 185 of the Constitution-Fourthly, direct intervention by the Supreme Court under Article 184(3) of the Constitution may adversely affect the rights of others--- Application filed by the applicant was held to be not maintainable with the observations that as far as the applicant's apprehension that his complaint/grievance would not be entertained by the Ministry of Defence, because the respondents had held senior positions in the Armed Forces, the Additional Attorney General assured the Court that the complaint/ grievance will be given due consideration; that there was no reason to doubt this statement made on behalf of the Government of Pakistan, therefore, the apprehension of the applicant is misplaced, and that, if the applicant submits a complaint/grievance to the Ministry of Defence of the Government of Pakistan, it shall be dealt with in accordance with law.

گاؤن کا بائیکاٹ کرو اور اس شرط کو ختم کرو۔۔

واہ جج صاحب ۔۔۔۔۔ اک ایہ ہی کم رہ گیا سی۔۔۔۔۔۔۔۔
کالے جوتے، سفید شرٹ اور کالے رنگ کا پنٹ کوٹ زیب تن کیے، کالی نک ٹائی باندھے ہوئے ایک نوجوان وکیل کسی خستہ حال شہری سے ہونے والی ناانصافی کا مقدمہ لے کر صوبہ پنجاب کی سب سے بڑی عدالت میں جج کے روبرو کھڑا ہوتا ہے۔ "تمھارا لباس عدالت کے ضابطے کے مطابق درست نہیں ہے اس لیے تمھارے ساتھ ہونی والی ناانصافی پر بات ہم نہیں سنیں گے، روسٹم (عدالت میں فریادی کے کھڑے ہونے کی جگہ) چھوڑ دو" جج صاحب نے حکم صادر کردیا۔
عدالت عالیہ میں وکلاء کی تنظیم پنجاب بار کونسل کے ممبر ایک تجربہ کار وکیل رانا محمد آصف موجود ہیں اور نوجوان وکیل کی مشکل بھانپ جاتے ہیں اپنا گاؤن اتار کر اس نوجوان وکیل کو پہنا دیتے ہیں اس کا یونیفارم عدالت کے اپنے بنائے ہوئے ضابطے کے مطابق ہو جاتا ہے یوں تجربہ کار وکیل صاحب ینگ لائر کا حوصلہ بڑھاتے ہیں کہ وہ معاشرے کے خستہ حال شہری کی مصیبت عزت مآب جج صاحب کے گوش گزارے۔
صوبہ پنجاب کی سب سے بڑی عدالت کا جج بہت زیادہ غصہ میں آ جاتا ہے اور معزز وکیل رانا محمد آصف ایڈووکیٹ کو کہتا ہے۔ تم نے نوجوان وکیل کو گاؤن پہنا کر توہین عدالت کی ہے۔توہین عدالت کی کاروائی کرتے ہوئے معزز وکیل رانا محمد آصف کو تین ماہ کی سزا سنائی جا چکی ہے، ینگ لائر کو بولنے نہیں دیا گیا اور خستہ حال شہری کی شکایت وہیں کی وہیں پڑی ہے۔
اب جب کہ لاہور ہائی کورٹ بار ایسوسی ایشن اور لاہور بار ایسوسی ایشن کے سینئر وکلاء نے جج صاحب سے کہا کہ اس طرح توہین عدالت نہیں ہوتی بلکہ توہین عدالت انصاف نہ کرنے سے ہوتی ہے۔ تو جج صاحب نے انھیں اپنا مرتبہ بتاتے ہوئے کہا کہ وہ puisne جسٹس ہیں اور جلد چیف جسٹس لاہور ہائیکورٹ لاہور ہوں گے۔
