📌کسی شخص کی جائیداد پر ناجائز قبضہ ہونے کی صورت میں متاثرہ فریق متعلقہ ٹریبیونل (ایڈیشنل سیشن جج) کے سامنے درخواست دائر کرتا ہے۔ ٹریبیونل ابتدائی جانچ کے لیے معاملہ سکروٹنی کمیٹی کو بھجواتا ہے تاکہ حقائق اور ریکارڈ کا جائزہ لیا جا سکے۔

📑سکروٹنی کمیٹی فریقین کو سننے، متعلقہ ریکارڈ کی پڑتال کرنے اور انکوائری مکمل کرنے کے بعد اپنی رپورٹ ٹریبیونل کو پیش کرتی ہے۔ دورانِ کارروائی قبضہ برقرار رکھنے یا مزید نقصان سے بچاؤ کے لیے حفاظتی احکامات اور عبوری ریلیف بھی حاصل کیا جا سکتا ہے۔

📌ٹریبیونل قبضہ اور ملکیت سے متعلق معاملات کا فیصلہ کرتے ہوئے ناجائز قبضہ ثابت ہونے پر قبضہ واگزار کرانے، معاوضہ دلوانے اور قانون کے مطابق سزا و جرمانہ عائد کرنے کا اختیار رکھتا ہے۔ اس قانون کے تحت مقدمات کو ترجیحی بنیادوں پر نمٹانے کی کوشش کی جاتی ہے تاکہ متاثرہ شخص کو جلد انصاف فراہم ہو سکے۔

✅ٹریبیونل کے فیصلے یا ڈگری سے متاثرہ فریق قانون میں مقررہ مدت کے اندر اپیل بھی دائر کر سکتا ہے۔

PLD 2015 Supreme Court 212 — مکمل خلاصہ
یہ مقدمہ اس اصولی سوال پر تھا کہ اگر مدعی ایک ہی دعویٰ میں دستاویزات کی تنسیخ (Cancellation) اور قبضہ (Possession) دونوں مانگے تو مدتِ میعاد (Limitation) کس ریلیف کے مطابق شمار ہوگی۔
مدعی نے دعویٰ کیا کہ اس کے نام الاٹ شدہ پلاٹ کے بارے میں جنرل پاور آف اٹارنی، معاہدۂ فروخت اور سیل ڈیڈز جعلسازی، دھوکہ دہی اور غلط بیانی کے ذریعے تیار کی گئیں۔ تقریباً 16 سال بعد اس نے ان دستاویزات کی تنسیخ اور پلاٹ کا قبضہ حاصل کرنے کے لیے دعویٰ دائر کیا۔
ٹرائل کورٹ اور اپیلٹ کورٹ نے دعویٰ مدتِ میعاد سے باہر قرار دے کر خارج کر دیا، لیکن ہائی کورٹ نے یہ کہتے ہوئے دعویٰ منظور کر لیا کہ اصل دعویٰ قبضہ کا ہے جس پر آرٹیکل 142 لمیٹیشن ایکٹ کے تحت 12 سال کی مدت لاگو ہوتی ہے۔
سپریم کورٹ نے اکثریتی فیصلہ (2:1) میں قرار دیا کہ:
مدعی کا بنیادی اور اصل مطالبہ دستاویزات کی تنسیخ تھا۔
قبضہ کا مطالبہ صرف ضمنی (Consequential) ریلیف تھا۔
چونکہ جعلسازی اور فراڈ کی بنیاد پر دستاویزات منسوخ کرانے کا دعویٰ سیکشن 39 Specific Relief Act کے تحت آتا ہے، لہٰذا اس پر آرٹیکل 91 Limitation Act کے مطابق 3 سال کی مدت لاگو ہوگی۔
جب بنیادی ریلیف ہی مدتِ میعاد سے باہر ہو تو اس کے ساتھ منسلک ضمنی ریلیف بھی ختم ہو جاتا ہے۔
مدعی کو 1971 اور 1974 میں متعلقہ معاملات کا علم تھا مگر اس نے بروقت قانونی کارروائی نہ کی، اس لیے وہ مدتِ میعاد اور اپنے طرزِ عمل کی وجہ سے دعویٰ کرنے سے محروم ہو گیا۔
نتیجتاً سپریم کورٹ نے ہائی کورٹ کا فیصلہ کالعدم قرار دے کر دعویٰ خارج کر دیا۔

اس مقدمہ میں سوال یہ تھا کہ آیا سرکاری ملازم کے دورانِ ملازمت وفات پانے یا مستقل معذور ہو کر ریٹائر ہونے کی صورت میں اس کے بیٹے، بیٹی، شوہر یا بیوہ کو بغیر اشتہار اور بغیر مقابلے کے سرکاری ملازمت دینا آئین کے مطابق ہے یا نہیں۔

سپریم کورٹ نے قرار دیا کہ:
ایسی تمام پالیسیاں، قواعد اور نوٹیفکیشنز جو سرکاری ملازمین کے اہلِ خانہ کو بغیر اوپن میرٹ اور اشتہار کے ملازمت دیتی ہیں، آئین کے خلاف ہیں۔
سرکاری ملازمت موروثی (Hereditary) حق نہیں ہے۔
ہر پاکستانی شہری کو سرکاری ملازمت کے حصول کے لیے مساوی موقع ملنا چاہیے۔
ملازمت صرف میرٹ، شفافیت اور کھلے مقابلے کے ذریعے دی جا سکتی ہے۔سپریم کورٹ نے واضح کیا کہ:
1. سرکاری نوکری وراثت نہیں
سرکاری ملازم کی وفات یا ریٹائرمنٹ کی بنیاد پر اس کے بچوں یا شریکِ حیات کو نوکری دینا آئین کے تصورِ مساوات کے خلاف ہے۔
2. میرٹ بنیادی اصول ہے
ریاستی ملازمتوں میں تقرری صرف:
اشتہار
مقابلہ
اہلیت
میرٹ
کی بنیاد پر ہو سکتی ہے۔
3. دوسرے شہریوں کے حقوق متاثر ہوتے ہیں
جب کسی ایک خاندان کو خصوصی رعایت دے کر نوکری دی جاتی ہے تو باقی اہل شہریوں کا آئینی حق متاثر ہوتا ہے۔
4. معاشی انصاف (Economic Justice)
ریاست کا فرض ہے کہ تمام شہریوں کو روزگار کے مساوی مواقع فراہم کرے، نہ کہ مخصوص خاندانوں کو ترجیح دے۔
تمام شہری قانون کی نظر میں برابر ہیں۔
عدالت نے قرار دیا کہ:
صرف اس بنیاد پر کہ کوئی شخص سرکاری ملازم کا بیٹا یا بیٹی ہے، اسے نوکری میں ترجیح دینا امتیازی سلوک (Discrimination) ہے۔
سرکاری ملازمتوں میں امتیاز ممنوع ہے۔
عدالت نے کہا کہ:
ریاستی ملازمتیں مخصوص خاندانوں کے لیے محفوظ نہیں کی جا سکتیں۔
ہر شہری کو کسی بھی جائز پیشے یا ملازمت میں داخل ہونے کا حق حاصل ہے۔
بغیر اشتہار تقرری:
دوسرے امیدواروں کو مقابلے سے محروم کرتی ہے۔
Article 18 کی خلاف ورزی ہے۔
ہر سرکاری ادارہ قانون کے مطابق کام کرنے کا پابند ہے۔
من مانی یا ترجیحی تقرریاں Article 4 کے خلاف ہیں۔
سپریم کورٹ نے کہا:
Government jobs cannot be made hereditary.
یعنی:
"سرکاری نوکریاں موروثی نہیں بنائی جا سکتیں۔"
مزید کہا:
The people's interest lies in having the best person for the job.
یعنی:
"عوام کے مفاد میں یہ ہے کہ ملازمت بہترین اور قابل شخص کو ملے۔"
سپریم کورٹ نے:
پشاور ہائی کورٹ کا فیصلہ کالعدم قرار دیا۔
وفاق اور صوبوں کے تمام ایسے قواعد و پالیسیاں غیر آئینی قرار دیں جن کے تحت:
بیوہ
شوہر
بیٹا
بیٹی
کو بغیر اشتہار اور میرٹ کے نوکری دی جاتی تھی۔
وفاقی اور صوبائی حکومتوں کو ایسی پالیسیاں واپس لینے کا حکم دیا۔

محمدن لا کی دفعہ 354 کے مطابق:
ماں حقِ حضانت سے محروم ہو سکتی ہے اگر:

کسی اجنبی شخص سے دوسری شادی کر لے۔

باپ سے بہت دور جا کر رہائش اختیار کر لے۔

بدکردار یا غیر اخلاقی زندگی گزار رہی ہو۔

بچے کی مناسب دیکھ بھال نہ کر رہی ہو۔

ملزم ظہیر عباس نے مقتولہ سلمیٰ بی بی سے شادی کی خواہش ظاہر کی تھی، لیکن مقتولہ پہلے ہی طارق زمان کے ساتھ منسوب تھی۔ 30 دسمبر 2018 کو ملزم مسلح ہو کر مقتولہ کے گھر داخل ہوا، اسے زبردستی ساتھ لے جانے کی کوشش کی۔ مقتولہ کی مزاحمت پر ملزم نے فائرنگ کر کے اسے قتل کر دیا۔ مقتولہ کی بہن نسرین بی بی نے ملزم کو پکڑنے کی کوشش کی جس دوران اس کی قمیض پھٹ گئی اور ملزم فرار ہو گیا۔
واقعہ کے فوراً بعد مقتولہ کی لاش پولیس اسٹیشن پہنچائی گئی اور صرف 40 منٹ میں رپورٹ درج کرا دی گئی۔ تفتیش کے دوران جائے وقوعہ سے دو خالی خ*ل برآمد ہوئے جن کی فرانزک رپورٹ سے ثابت ہوا کہ دونوں ایک ہی ہتھیار سے فائر ہوئے تھے۔
استغاثہ نے مقتولہ کے بھائی (شکایت کنندہ) اور بہن (عینی گواہ) کو پیش کیا۔ دونوں کے بیانات میں مکمل مطابقت پائی گئی۔ دفاع ان کی موجودگی اور سچائی پر کوئی مؤثر ضرب نہ لگا سکا۔
طبی شہادت سے ثابت ہوا کہ مقتولہ کو قریب سے گولیاں ماری گئیں، جس کی تصدیق زخموں کے گرد موجود ٹیٹوئنگ (Tattooing)
سے ہوئی۔ یہ امر عینی گواہوں کے بیان کے مطابق تھا کہ مقتولہ کو پکڑ کر قریب سے فائر کیا گیا۔
عدالت نے قرار دیا کہ:
ایف آئی آر فوری درج ہوئی۔
عینی گواہان کی موجودگی فطری اور ثابت شدہ تھی۔
طبی اور فرانزک شواہد استغاثہ کی مکمل تائید کرتے ہیں۔
ملزم کافی عرصہ مفرور رہا۔
محرک بھی قرائن سے ثابت ہوتا ہے۔
لہٰذا ہائی کورٹ نے ملزم کی اپیل مسترد کر دی اور ٹرائل کورٹ کی سزا کو برقرار رکھا۔
مزید برآں، شکایت کنندہ کی جانب سے دائر کردہ سزا میں اضافہ کی درخواست منظور کرتے ہوئے عدالت نے قرار دیا کہ ٹرائل کورٹ نے بلاجواز عمر قید کی سزا دی۔ چونکہ مقتولہ ایک کم عمر لڑکی تھی، قتل نہایت سفاکانہ انداز میں گھر میں گھس کر کیا گیا، جرم پوری طرح ثابت تھا اور کوئی تخفیفی پہلو موجود نہیں تھا، اس لیے عمر قید کو سزائے موت میں تبدیل کر دیا گیا۔

ناجائز اسلحہ کی روک تھام کیلئے Punjab Arms Ordinance میں انقلابی ترامیم۔
انتہائی سخت سزائیں اور انتہائی بھاری جرمانہ۔
Punjab Arms (Amendment) Act 2025 (XLI of 2025).
غیر ممنوعہ بور کا اسلحہ رکھنے پر زیادہ سے زیادہ سزا پانچ سال کم از کم سزا تین سال کم از کم جرمانہ دس لاکھ۔
غیر ممنوعہ بور کا اسلحہ لیکر چلنے یا نمائش پر زیادہ سے زیادہ سزا سات سال کم از کم سزا تین سال کم از کم جرمانہ بیس لاکھ۔

ممنوعہ بور کا اسلحہ رکھنے پر زیادہ سے زیادہ سزا سات سال کم از کم سزا چار سال کم از کم جرمانہ بیس لاکھ۔
ممنوعہ بور کا اسلحہ لیکر چلنے یا نمائش پر زیادہ سے زیادہ سزا دس سال کم از کم سزا سات سال کم از کم جرمانہ بیس لاکھ۔

دو ممنوعہ یا پانچ غیر ممنوعہ بور کا اسلحہ رکھنے پر زیادہ سے زیادہ سزا پانچ 14 سال کم از کم سزا دس سال کم از کم جرمانہ تیس لاکھ۔

13(2)
(a) keeping or possessing of a non-prohibited bore weapon, ammunition of non-prohibited bore weapons or military stores, shall be punishable with imprisonment for a term which may extend to five years but shall not be less than three years and with fine not less than one million rupees, and in case of default of payment of fine, the offender shall undergo further imprisonment for six months; or

(b) carrying or displaying of a non-prohibited bore weapon, ammunition of non-prohibited bore weapons or military stores, shall be punishable with imprisonment for a term which may extend to seven years but not less than three years and with fine not less than two million rupees, and in case of default of payment of fine, the offender shall undergo further imprisonment for six months; or

(c) keeping or possessing of a prohibited bore weapon or ammunition of prohibited bore weapons, shall be punishable with imprisonment for a term which may extend to seven years but not less than four years and with fine not less than two million rupees, and in case of default of payment of fine, the offender shall undergo further imprisonment for one year; or

(d) carrying or displaying of a prohibited bore weapon or ammunition of prohibited bore weapons, shall be punishable with imprisonment for a term which may extend to ten years but shall not less than seven years and with fine not less than two million rupees, and in case of default of payment of fine, the offender shall undergo further imprisonment for one year; or

(e) carrying or possessing of two or more prohibited bore weapons or five or more non-prohibited bore weapons or one prohibited bore weapon and two non-prohibited bore weapons, shall be punishable with imprisonment for a term which may extend to fourteen years but not less than ten years and with fine which shall not be less than three million rupees, and in case of default of payment of fine, the offender shall undergo further imprisonment for two years; or

(f) undertaking repairs or manufacturing any arms, ammunitions or running a gun shooting club, shall be punishable with imprisonment for a term which may extend to seven years but not less than five years and with fine which shall not be less than three million rupees and in case of default of payment of fine, the offender shall undergo further imprisonment of two years.].

It is well-settled that the documents sought to be tendered in evidence could not have been exhibited through the statement of learned counsel, as such mode of proof does not satisfy the mandatory requirements of law. Mere production or tendering of documents by counsel does not dispense with the legal requirement of proof under the Qanun-e-Shahadat Order, 1984, nor can such documents be treated as duly exhibited without being proved through competent witnesses.

Once ex*****on of the cheque stood either admitted or sufficiently proved through oral and documentary evidence, the statutory presumption under Section 118 of the Negotiable Instruments Act, 1881 came into operation, whereby every negotiable instrument is presumed to have been drawn for consideration.

It is well-settled that even a blank signed cheque, if voluntarily handed over, carries legal consequences under the Negotiable Instruments Act once consideration is presumed and not disproved. The defence, therefore, remained in the realm of mere denial, which cannot dislodge the plaintiff’s otherwise supported claim.

It is settled law that legal representatives step into the shoes of the deceased for purposes of civil liability to the extent of estate inherited.

Article 10-A of the Constitution guarantees the fundamental right to a fair trial and due process in the determination of criminal charges as well as civil rights and obligations. Under Article 187 of the Constitution, the Supreme Court possesses the authority to issue such directions, orders, or decrees as may be necessary for doing complete justice in any case or matter pending before it. This constitutional power obligates all executive and judicial authorities including the High Courts, throughout Pakistan to act upon the directions of the Supreme Court to ensure effective implementation of statutory mandates for the purpose of regulating judicial process.

Supreme Court issue directions to all courts across the country exercising jurisdiction under the ILLEGAL DISPOSSESSION ACT, to ensure that they adhere to the following instructions, in addition to the procedure prescribed by the Act:

(i) Every Trial Court seized of a complaint under the Act upon taking cognizance of the complaint should complete the same within 60 days time frame specified by section 5(2) of the Act and maintain a day-to-day order sheet of proceedings accordingly;

(ii) Where the trial cannot proceed on the date fixed for hearing, the Trial Court shall, specifically record sufficient reasons in the order sheet for the delay. Bare references to "non-availability of witnesses" or "adjournment sought by counsel" shall not constitute sufficient reasons for the purposes of section 5(2);

(iii) No adjournment shall be granted as a routine. However, the grant of any adjournment shall be based on justifiable reason;

(iv) Member Inspection Team of the respective High Courts/Director General District Judiciary shall periodically monitor all cases pending under the Act,before Trial Courts in their respective jurisdictions, identifying: (a) the date of filing of complaint; (b) the date of taking cognizance in the matter/framing of charge against the accused; (c) the status of pending proceedings; and
(d) where the sixty-day period has been exceeded, the reasons recorded therefor;

(v) The complaint shall accompany the list of witnesses and shall ensure their presence on each date fixed by the Trial Court for recording their statements. The complainant and the accused,represented by a counsel, shall ensure presence of their counsel before the court on every date of hearing.

(vi) In case any party challenges an interim order of the Trial Court before a higher forum, the Trial Court must proceed with the trial, unless a restraining order is passed by a higher forum.
