⚖️ 30 Days? Think Again! — Lahore High Court Clarifies Ex-Parte Proceedings

Were you proceeded against ex-parte in a civil case? You may have more time than you think.

The Lahore High Court clarified that an application under Order IX Rule 7 CPC for setting aside ex-parte proceedings is not subject to a specific 30-day limitation. Article 181 of the Limitation Act may provide a period of three years.

⚖️ Expert Opinion Alone Is Not Enough

A positive firearm expert report cannot, by itself, establish an accused’s guilt when the alleged weapon recovery lacks independent corroboration.

In Muhammad Ramzan v. The State (2025 SCMR 1742), the Court emphasized that where the recovery of the crime weapon is found unreliable, the evidentiary value of the firearm expert’s report in connecting the accused with the offence is also substantially weakened.
