پشاور ہائی کورٹ مینگورہ بنچ بار ایسوسی ایشن کے معزز ممبر، محترم عطاء اللہ جان ایڈووکیٹ کو آج ایک بزدلانہ قاتلانہ حملے میں شہید کر دیا گیا ہے۔

پشاور ہائی کورٹ مینگورہ بنچ بار ایسوسی ایشن اس اندوہناک اور دلخراش واقعے پر گہرے رنج و غم اور شدید افسوس کا اظہار کرتی ہے۔ مرحوم ایک باوقار، فرض شناس اور قانون کی بالادستی پر یقین رکھنے والے وکیل تھے، جن کی شہادت وکلا برادری کے لیے ایک ناقابلِ تلافی نقصان ہے۔ بار ایسوسی ایشن متعلقہ اداروں سے پرزور مطالبہ کرتی ہے کہ اس سفاکانہ واقعے میں ملوث تمام عناصر کو فوری طور پر گرفتار کر کے قانون کے کٹہرے میں لایا جائے اور انہیں قرار واقعی سزا دی جائے، تاکہ آئندہ اس قسم کے افسوسناک واقعات کی روک تھام ممکن بنائی جا سکے۔

پشاور ہائی کورٹ، مینگورہ بنچ بار ایسوسی ایشن نے اس اندوہناک سانحہ پر گہرے دکھ اور افسوس کا اظہار کرتے ہوئے ممبران خیبر پختونخواہ بار کونسل ملاکنڈ ڈویژن کے مشاورت سے ملاکنڈ ڈویژن میں تین (3) روزہ سوگ کا اعلان کرتی ہے۔ اس دوران وکلاء صاحبان بطور احتجاج عدالتوں میں پیش نہیں ہوں گے۔

پشاور ہائی کورٹ مینگورہ بنچ بار ایسوسی ایشن شہید کے لواحقین کے غم میں برابر کی شریک ہے۔
اللہ تعالیٰ مرحوم کو جوارِ رحمت میں اعلیٰ مقام عطا فرمائے اور پسماندگان کو صبرِ جمیل عطاء فرمائے۔ آمین۔

----S. 25---Non-custodial parent, rights of---Minor girl---Overnight stay with father.......Non-custodial parent has all the rights to meet his/her children and neither right of access to his/her minor children can be denied nor a non-custodial parent will be considered as an alien to his/her children---A minor not only needs love, affection, care and attention of a mother but also the father and negating a non-custodial parent of his/her right to meet his/her minor children would lead to emotional deprivation.

Once acquittal is recorded, double presumption of innocence is created which cannot be interfered unless the appellate Court reaches the conclusion that findings are speculative and artificial or arbitrary---Possibility of formulation of another opinion by itself will not be sufficient to make interference.

The petitioner statedly remained an absconder in this case for a period of 10 years but it is by now well settled that mere abscondence of an accused by itself is no ground to refuse bail to him if otherwise he is entitled to the said relief on merits.
