𝗔𝗖𝗖𝗜𝗢𝗡 𝗜𝗡𝗧𝗘𝗥𝗗𝗜𝗖𝗧𝗔𝗟 — 𝗞𝗮𝗽𝗮𝗴 𝗜𝗻𝗮𝗴𝗮𝘄𝗮𝗻 𝗼 𝗔𝘆𝗮𝘄 𝗡𝗮𝗻𝗴 𝗨𝗺𝗮𝗹𝗶𝘀 𝘀𝗮 𝗣𝗿𝗼𝗽𝗲𝗿𝘁𝘆

“𝘚𝘪𝘯𝘰 𝘢𝘯𝘨 𝘮𝘢𝘺 𝘬𝘢𝘳𝘢𝘱𝘢𝘵𝘢𝘯𝘨 𝘩𝘶𝘮𝘢𝘸𝘢𝘬 𝘰 𝘮𝘢𝘯𝘢𝘵𝘪𝘭𝘪 𝘴𝘢 𝘱𝘳𝘰𝘱𝘦𝘳𝘵𝘺 𝘴𝘢 𝘯𝘨𝘢𝘺𝘰𝘯?”

Dito pumapasok ang ACCION INTERDICTAL.

Sa ilalim ng Rule 70 of the Rules of Court, ang accion interdictal ay isang summary action for ejectment para mabawi ang physical or actual possession (possession de facto) ng lupa o building. May dalawang uri ito: Forcible Entry at Unlawful Detainer.

1. FORCIBLE ENTRY

force, intimidation, threat, strategy, or stealth.

⏳ MAHALAGA ANG ONE-YEAR PERIOD

Generally, ang accion interdictal ay dapat maihain within one (1) year as contemplated under Rule 70.

Sa unlawful detainer, the one-year period is generally reckoned from the last demand to vacate, under the circumstances recognized by jurisprudence.

🏛️ SAAN IFA-FILE?

Sa property cases, dates and manner of possession matter.

Legal Basis: Rule 70, Rules of Court; jurisprudence of the Supreme Court on forcible entry, unlawful detainer, and possessory actions.

For general legal information only. The proper remedy still depends on the specific facts of each case.

PUBLIC ROADS BELONG TO THE PEOPLE

Not everything beside your house is yours.
Under Articles 420 and 424 of the Civil Code, roads intended for public use are properties of public dominion. This means they belong to the public and not to any private individual, regardless of how long the area has been occupied or maintained.

Placing chains, gates, potted plants, rocks, or any other obstruction on a public road or road shoulder does not create ownership. Such acts may even constitute a public nuisance and may be removed by the proper authorities in accordance with law.

Remember:
Your property ends at your boundary. The road begins where the public's right starts.

LEGAL AWARENESS: VIOLATIONS OF REPUBLIC ACT NO. 9165

Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, penalizes various unauthorized activities involving dangerous drugs.

Common violations include:

• Section 5 – Sale, trading, administration, delivery, distribution, or transportation of dangerous drugs
• Section 11 – Illegal possession of dangerous drugs
• Section 12 – Possession of equipment, instruments, or drug paraphernalia
• Section 13 – Possession of dangerous drugs during parties, social gatherings, or meetings
• Section 15 – Unauthorized use of dangerous drugs, subject to the requirements provided by law
• Operating, maintaining, or working in a drug den, laboratory, or similar establishment
• Manufacturing, cultivating, or financing activities involving dangerous drugs

The penalties imposed under RA 9165 are severe and may include lengthy imprisonment, life imprisonment, substantial fines, rehabilitation, and other legal consequences. The applicable charge and penalty depend on the particular act committed, the type and quantity of the substance, and the circumstances surrounding the case.

📌 An arrest or criminal charge does not automatically mean that the accused is guilty.

The prosecution must prove every element of the alleged offense beyond reasonable doubt. In cases involving seized dangerous drugs, courts must also examine whether the identity and integrity of the alleged evidence were properly preserved through the required chain of custody.

A person arrested or investigated for an alleged violation of RA 9165 has the right:

✓ To remain silent
✓ To be informed of the nature of the accusation
✓ To have competent and independent legal counsel
✓ To be protected against unlawful searches and seizures
✓ To due process and the presumption of innocence
✓ To question the legality of the arrest and the admissibility of the evidence

Anyone facing a drug-related complaint should avoid signing statements or documents without fully understanding their contents and without first consulting legal counsel.

Every criminal case is different. The legality of the arrest, search, seizure, laboratory examination, handling of evidence, and compliance with the chain-of-custody requirements must be evaluated based on the specific facts and available evidence.

This post is intended for general legal information and public awareness only. It does not constitute legal advice and does not create an attorney-client relationship.
