Celebrating small wins.

We’re grateful to share that the court recently granted a client’s petition involving the correction/cancellation of entries in a Certificate of Live Birth (other details withheld for confidentiality). Under Rule 108, courts may order the correction/cancellation of civil registry entries after meeting procedural and substantive due process requirements.

Not all birth certificate issues are purely “clerical.” Some are handled administratively under RA 9048, as amended by RA 10172, while others require a judicial petition.

Notarized na—ibig bang sabihin totoo na agad ang nakasulat at valid na ang dokumento? ❌ HINDI.

Marami sa atin ang naniniwala na kapag may “tatak” na ng Notary Public ang isang dokumento, hindi na ito puwedeng kuwestiyunin. Pero ayon sa Korte Suprema sa Anido v. Republic (G.R. No. 253527, Oct. 21, 2024), maling akala ito.

Ang trabaho ng notary public ay i-confirm ang due execution—na ang pumirma ay siya nga (at kusang-loob niyang inacknowledge ang dokumento). Pero hindi nito awtomatikong pinapatunayan na totoo ang bawat statement sa loob ng nasabing dokumento.

Sa madaling salita: notarization may prove who signed (and that it was properly acknowledged), but it does not necessarily prove the truth of the contents.

🛑 STOP scrolling if you work 5-days per week!

Did you know that the 5-day workweek is actually a choice made by your employer? 🤯

Under Art. 83 in relation to Art. 91 of the Labor Code, the law assumes a 6-day-per-week schedule. Nevertheless, this doesn't deprive the employer of the prerogative to prescribe and regulate this aspect of employment in good faith, such as by prescribing a 5-day-per-week schedule when it is more favorable to the employee. It is important to understand this distinction to know how employees benefits and rest days are structured.
