When a document is signed in front of a notary public, it becomes an official or “public” document. That means the law assumes the document is real, properly signed, and truthful.

If someone wants to challenge the document, they must show strong and clear evidence that something’s wrong with it. Without that kind of proof, the document is considered valid and binding.

Steps to Replace a Lost Owner’s Duplicate Certificate of Title:

Notice of Loss: The registered owner or interested person must immediately notify the Register of Deeds in the city or province where the land is located.

Petition in Court: File a petition entitled in the original case where the certificate of title was issued. The petition must state under oath how and when the loss occurred.

Notice and Hearing: The court may set a hearing date, giving notice to the Register of Deeds and all listed interested parties based on the original title's encumbrances.

Issuance of New Title: If the court is satisfied after the hearing, it will order the Register of Deeds to issue a new duplicate certificate. This will bear a memorandum stating that it replaces the lost original but is legally valid just the same.
