Legal Alert: May Mali sa Birth Certificate Mo?

Hey everyone! Napansin mo ba na may maling entry sa birth certificate mo?

Halimbawa: mali ang buwan ng kapanganakan, maling spelling ng first name, o mali ang s*x? Relax lang, hindi agad kailangan na dumaan ito sa korte. May administrative remedy para dito.

Sa ilalim ng Republic Act No. 10172 (amending RA 9048), pinapayagan ang pag-correct ng ilang clerical or typographical errors sa birth certificate sa pamamagitan ng petition sa Local Civil Registrar, nang hindi na dumadaan sa korte.

Pero tandaan: minor errors lang ang sakop nito.

Ayon sa batas, maaari mong ipa-correct ang mga sumusunod:

1. Day o month ng kapanganakan kung mali ang nailagay.
2. S*x, kung ito ay malinaw na clerical o typographical error.
3. First name kung mali ang spelling o hindi ang ginagamit mo sa mga records mo.

Para maisagawa ang correction, kailangan mong mag-file ng verified petition at magsumite ng mga dokumentong magpapatunay ng tamang impormasyon, tulad ng:

1. Certified true copy ng birth certificate na may error.

2. Hindi bababa sa dalawang supporting documents, tulad ng:

* earliest school records
* medical records
* baptismal certificate
* iba pang government o religious records

3. Police clearance o certification na wala kang pending criminal case.

4. Kung s*x ang ipa-correct, kailangan ng certification mula sa government physician na walang s*x change o transplant na naganap.

5. Publication ng petition sa isang newspaper of general circulation once a week for two consecutive weeks.

Ngunit kung ang correction ay substantial, halimbawa ay pagbabago ng age, legitimacy, o civil status, hindi na ito sakop ng administrative correction. Kailangan na itong idaan sa judicial proceedings sa ilalim ng Rule 108 ng Rules of Court.

Bottom line: Hindi lahat ng mali sa birth certificate ay kailangang idaan sa korte, pero hindi rin lahat ay pwedeng administratively lang.

Kung may mali sa birth certificate mo, alamin muna kung ito ba ay clerical error o substantial correction para malaman kung ano ang tamang proseso.

Hey ladies! Did you know? When you tie the knot, you're not required to adopt your spouse's surname? That's right! The choice to use your husband's surname is entirely yours.

In a landmark ruling (Remo v. Hon. Secretary of Foreign Affairs, G.R. No. 169202, March 5, 2010), the Supreme Court affirmed:
"Clearly, a married woman has an option, but not a duty, to use the surname of the husband in any of the ways provided by Article 370 of the Civil Code. She is therefore allowed to use not only any of the three names provided in Article 370, but also her maiden name upon marriage. She is not prohibited from continuously using her maiden name once she is married because when a woman marries, she does not change her name but only her civil status." So, feel free to keep rocking your maiden name post-marriage!

According to Article 370 of the New Civil Code, you have the right to decide what to do with your surname after marriage. You can:

1. Combine your maiden name with your spouse's surname.
2. Use your maiden name alongside your spouse's surname.
3. Adopt your spouse's full name with a prefix like "Mrs."
4. Stick with your maiden name.

For instance, if your spouse's name is Alden Richards and yours is Katherine Bernardo:

1. Katherine Bernardo-Richards
2. Katherine B. Richards
3. Mrs. Alden Richards
4. Katherine Bernardo
