Why do notaries charge so much for just stamping?

And how can you tell if you are talking to a real notary or a fake one?

The truth is you aren't just paying the notary for stamping the document.

Notaries are required to submit a physical copy of the documents to the court every month so that the court has an actual copy.

Notaries are also required to record all the pertinent information on the document in a physical book called the notarial register in case anyone asks.

Notarization makes something a public document which to avoid too much legalese just means it is easier to rely on truthfulness of the document in case there is a court case.

In short, the notarization procedure is for your protection and that protection matters more when the value of the contract is bigger such as when land or property is involved.

Lawyers have been disbarred and suspended for notarizing contracts they weren't supposed to.

That is why usually the cost of notarizing a document is usually higher for transactions involving property because the risk is higher for the notary.

That and the Integrated Bar of the Philippines usually prescribes higher fees for said documents.

So when you are notarizing, make sure you get your moneys worth - by making sure they are actually submitting it to the court.

Fake notaries are common in the Philippines as you can literally find some on the sidewalk and the public doesn't know any better.

So how can you tell if you are talking to a fake notary?

Here are some signs:

1. They don't ask for their own copy of the contract. If they don't ask for a copy, it would be impossible for them to submit one to the court.

2. They don't have a notarial register. This is usually a blue book where you write the entries. You have the right to ask to see a copy of the notarial register. (Note: sometimes, its just a loose paper with page numbers, and you are asked to sign on it as well.)

3. They aren't a lawyer. Only lawyers can be notaries. You can easily verify who all the lawyers are at the supreme court website. https://sc.judiciary.gov.ph/lawlist/

4. The notary stamp will say what city the notary is registered at. You can call the city hall clerk of court to verify if they are indeed a notary.

I say all this to stop explaining to people why some notaries seem stricter than others.

It's not that we're trying to make things hard for you.

It's just we do a lot of things that aren't obvious besides the stamping.

All in all my ultimate hope is that the Supreme Court allows fully digital and online notarization.

That would be both more convenient for the public and easier for the lawyer.
