When a grave accusation such as r**e is brought before the Court, it must be proven with clarity and certainty.

Tugadi Law Office received the Court’s ruling granting the Demurrer to Evidence in favor of our client, after the prosecution failed to meet the burden of proving guilt beyond reasonable doubt.

In the absence of sufficient evidence, the Court upheld a fundamental right, the presumption of innocence.

As a result, our client is ACQUITTED of the crime of r**e on the ground of insufficiency of evidence.

Earlier today, Tugadi Law received the news in open court that its client was acquitted of the crime of Illegal Possession of Deadly Weapon penalized under Kauutusang Pambayan Bilang 07-2003 of Biñan City, Laguna.

The acquittal comes after the prosecution has failed to prove his guilt beyond reasonable doubt.

The Regional Trial Court of Manila City recently granted the Demurrer to Evidence filed by Tugadi Law Office and consequently DISMISSED the case against our client.

In granting the Demurrer to Evidence, the Court ruled that the prosecution failed to adduce sufficient evidence and to discharge with its burden to prove the guilt of the accused beyond reasonable doubt.

The Court reminded the need to strictly comply with Section 21 of RA 9165, as amended by RA No. 10640, on the custody and disposition of evidence. “Where the State fails to comply with the said rules, the Court imposes upon the prosecution the duty to present evidence that would demonstrate the identity of each individual in the chain of custody, and the manner of handling the corpus delicti, which is the dangerous drug itself. Only then will the Court be able to ensure that presumption of innocence, a primordial right enshrined under the Constitution, is accordingly bestowed upon the accused.”
