In 𝐃𝐞 𝐆𝐮𝐳𝐦𝐚𝐧-𝐋𝐚𝐫𝐚 𝐯. 𝐂𝐎𝐌𝐄𝐋𝐄𝐂 𝐚𝐧𝐝 𝐌𝐚𝐦𝐛𝐚, 𝐆.𝐑. 𝐍𝐨. 𝟐𝟔𝟓𝟖𝟒𝟕, 𝐀𝐮𝐠𝐮𝐬𝐭 𝟎𝟔, 𝟐𝟎𝟐𝟒, the SC ruled that a petition for disqualification filed via email at 6:21 PM on May 10, 2022 was timely, despite being submitted after office hours.

The COMELEC dismissed the petition on the ground that electronic filing beyond office hours are deemed filed at 8:00 AM the next working day, thus rendering the filing late.

However, the SC emphasized that under Article 13 of the Civil Code, “day” refers to a full 24-hour period, and that advancement of technology permit valid filings via email beyond regular working hours, as long as they are completed within the same day. SC found that COMELEC committed grave abuse of discretion in dismissing the petition and ordered that the case be remanded for resolution on the merits.
