If you are married to a foreigner and have a foreign divorce,

DO NOT file for Annulment.

A Petition for Recognition of Foreign Judgment is generally faster

and cheaper because you are simply asking the Philippine court to

"acknowledge" a document that already exists.

You don't have to prove your ex was "psychologically

incapacitated"β€”you just have to prove the divorce happened

legally abroad.

a moral dutyβ€”it is a strict legal obligation.

Under the Family Code of the Philippines,

"Support" (Sustento) covers everything

indispensable for sustenance, dwelling,

clothing, medical attendance, and education.

In the recent case of Carnabuci v. TagaΓ±a-Carnabuci

(G.R. No. 253527), the Supreme Court emphasized

that being an OFW does not strip a parent of their

rights, but it also doesn't exempt them from their

responsibilities. The Court ruled that even from

abroad, a parent must provide monthly financial

support, and failure to do so can lead to legal

consequences under R.A. 9262 (Economic Abuse).
