MARRIAGES CELEBRATED ABROAD

REMOVING FATHER’S SURNAME FROM MY NAME;
ILLEGITIMATE CHILD

Minor or clerical corrections to a birth record may be corrected administrativel. However, the following will generally require a court order:

1. Changing a legitimate child’s surname from father’s surname to mother’s surname.

2. Removing the father’s surname from the birth certificate of an illegitimate child who was acknowledged by the father.

Therefore, if you wishes to change her surname that does not merely involve minor typographical errors, the same will most likely proceed through the filing of a case in court.

Courts will assess the reasons to ensure that removing the father’s surname will serve to the best interest of the child and does not infringe upon any legal rights or obligations.

MGA DOKUMENTONG PATUNAY NG PAGMAMAY-ARI.

Tandaan, maraming klase ng dokumento. Ngunit, ano nga ba ang mga legal at tamang dokumento para makasiguro na ang binbili mo ay mula mismo sa tunay na may-ari?

1. OWNER’S DUPLICATE OF TRANSFER / CONDOMINIUM CERTIFICATE OF TITLE - Ito ang pinaka depinitibong katibayan ng pagmamay-ari ng isang lupa o condominium. Ito ay iniisue ng Registry of Deeds kung nasaan ang nasabing lupa o condominium.

2. CONDITIONAL GOVERNMENT TITLE FOR AGRICULTURAL LANDS (CLOA) - Ito ay iniissue ng Department of Agrarian Reform (DAR) sa mga qualipikadong agrarian reform beneficiaries, ngunit may mga ilang restrictions sa paglilipat at pagbebenta nito.

3. PATENT - Ang Free Patent o Homestead Patent at iniissue ng Department of Environment and Natural Resources (DENR), na ginagawa ang mga disposable public state lands sa pribadong properties.

4. DEED OF ABSOLUTE SALE - Isang notaryadong kasunduan kung saan ibinebenta ang isang ari-arian sa isang tao para sa isang spesipiko na halaga. Ngunit, ito ay katunayan lamang ng kontrata ng mga partido pero hindi pa ito katunayan ng final na pagmamay-ari.

5. TAX DECLARATION - Iniissue ito ng local assessor para sa pagbabayad ng amelyar o real property tax (RPT). Ito ay katunayan lamang ng pagbabayad ng amelyar o RPT at possession sa lupa / property pero hindi ito katunayan ng pagmamay-ari.

FAILURE OF REAL ESTATE DEVELOPER TO CONSTRUCT OR TURN-OVER PROPERTY PURCHASED
