A TIME FOR EVERYTHING… ⚖️

Being a lawyer is more than a profession. It is a service to mankind.

I still remember what our Dean told us when we passed the Bar. He said he was very happy because he knew that, as lawyers, we would now have the opportunity to help many—especially the oppressed, the lowly, and the less fortunate.

Those words have stayed with me.

I have always believed that becoming a lawyer is neither an accident nor simply a matter of luck. There is a greater purpose behind this calling. We are given the opportunity to do something meaningful—not only for ourselves and our families, but also for others and for our country.

But with the privilege of being called a lawyer comes a greater responsibility.

We are expected to uphold high standards of integrity, morality, and professionalism. We are defenders of justice and officers of the court. We must remain faithful to the law, respectful of the institutions we serve, and steadfast in protecting the rights of those who seek our help.

Above all, we owe our clients competence, diligence, loyalty, and utmost faithfulness. Their trust is never something we should take lightly.

There is indeed a time for everything—a time to learn, a time to struggle, a time to succeed, and a time to use what we have learned in the service of others.

⚖️ 9 STEPS TO DECLARATION OF NULLITY OF MARRIAGE IN THE PHILIPPINES

1️⃣ CONSULT A LAWYER
Find out first whether your circumstances constitute a legal ground for nullity.

2️⃣ GATHER YOUR DOCUMENTS
Marriage certificate, birth certificates, proof of residence, and other relevant evidence.

3️⃣ FILE THE PETITION
Your lawyer prepares and files the petition before the proper Family Court.

4️⃣ SERVE THE PROPER PARTIES
The respondent and the appropriate government offices are notified.

5️⃣ PROSECUTOR’S INVESTIGATION
The prosecutor determines whether there is collusion between the spouses.

6️⃣ PRESENT YOUR EVIDENCE
Witnesses, documents, and other evidence are presented before the court.

7️⃣ COURT DECISION

# # # 🌾 DO YOU STILL NEED DAR CLEARANCE TO TRANSFER AGRICULTURAL LAND?

There is an important new legal development for **owners, buyers, and sellers of agricultural land.**

⚖️ In **DOJ Opinion No. 16, s. 2026**, dated March 9, 2026, the Department of Justice expressed the view that the requirement to obtain a **DAR Land Transfer Clearance (LTC)** before transferring private agricultural land **no longer has legal basis**.

**Why?** According to the DOJ, the period given by law for CARP’s acquisition and distribution of private agricultural lands already ended on **June 30, 2014**.

In simple terms, the DOJ’s position is:

> **If the legal basis for requiring the clearance has already ceased, the clearance should no longer be required for the transfer of private agricultural land.**

🏡 **What does this mean for you?**

This may make the process of **selling, buying, donating, or transferring private agricultural land** less complicated, particularly when DAR Land Transfer Clearance was previously being required for registration.

However, take note: **this is a DOJ legal opinion.** Before proceeding with any land transaction, it is still important to verify the current requirements of the **DAR, LRA, and Registry of Deeds** applicable to your property.

⚖️ MUST HEIRS FIRST BE JUDICIALLY DECLARED BEFORE THEY CAN ASSERT THEIR SUCCESSIONAL RIGHTS?

Not necessarily.

The Supreme Court, in Treyes v. Larlar, abandoned the rigid approach that heirs must first obtain a judicial declaration of heirship in a separate special proceeding before they can enforce rights arising from succession.

The Court clarified that a prior declaration of heirship is not required when there is no pending special proceeding for the settlement of the decedent’s estate.

This is consistent with Article 777 of the Civil Code, which provides that:

> “The rights to the succession are transmitted from the moment of the death of the decedent.”

Thus, when no estate settlement proceeding is pending, legal heirs may institute an ordinary civil action to protect or enforce rights arising from succession, and the question of heirship may be determined in that action when necessary.

The important qualification: if a special proceeding for the settlement of the estate is already pending, questions concerning heirship should generally be resolved in that proceeding.

📸 WHY IS A PHOTO IMPORTANT WHEN POSTING BAIL?

“If a police mugshot is not always required, why does the court still ask for photographs?”

Because IDENTITY MATTERS. ⚖️

When an accused posts bail, photographs help the court confirm that the person posting bail is the very same person charged in the criminal case.

Under the bail requirements, photographs of the accused showing the front, left, and right profiles serve important purposes: they help verify identity, prevent mistaken identity or substitution, and provide the court with a reliable identification record.

But here’s an important distinction:

📸 COURT-REQUIRED PHOTO ≠ 🚔 POLICE MUGSHOT

A photograph submitted as part of the court’s bail requirements is not necessarily the same thing as a police-administered mugshot or booking sheet.

A police mugshot generally forms part of police booking and custodial processing. Thus, when an accused posts bail directly before the court without having been taken into police custody, the absence of a police-administered mugshot does not necessarily mean that the court has no photograph of the accused.

The simple takeaway:
👉 Bail photo = identification for court records.
👉 Police mugshot = part of police booking/custodial procedures.

So when discussing bail, don't confuse “no police mugshot required” with “no photograph required at all.”

⚖️ Know the distinction. Know your rights. Know the procedure.

Legal basis: OCA Circular No. 204-2022-AA and applicable Supreme Court bail requirements.
