LEGAL TIP: A Contract Is the Law Between the Parties

Many people believe that a verbal agreement is not binding. Under Philippine law, contracts are generally valid even if not in writing, as long as the essential requisites are present: (1) consent, (2)object/subject matter, and (3) cause/consideration.

However, some agreements must be in writing (or in a specific form) to be enforceable or to serve particular purposes, such as certain transactions involving real property where a public instrument is required for convenience and registrability.

To avoid disputes, it is still best to put agreements in writing and ensure all terms are clear and understood by the parties. A well-drafted contract protects not only your rights but also your peace of mind.

When in doubt, consult a lawyer before signing or even before paying or delivering anything.
