CRIMINAL LIABILITY OF A MINOR UNDER THE JUVENILE JUSTICE AND WELFARE ACT (RA 9344, as amended by RA 10630)

Understanding the law helps us appreciate how the Philippine justice system balances accountability with rehabilitation for children in conflict with the law.

Who is criminally liable?

🔹 15 years old and below

Exempt from criminal liability.
Subject to an intervention program through the Local Social Welfare and Development Office (LSWDO).

🔹 Above 15 but below 18 years old (without discernment)

Exempt from criminal liability.
Subject to an intervention program.

🔹 Above 15 but below 18 years old (with discernment)

May be held criminally liable.
Entitled to the special procedures and protections provided under RA 9344, including diversion, rehabilitation, and, when applicable, suspension of sentence.

🔹 18 years old and above

Criminally liable as an adult under the Revised Penal Code and other applicable laws.

What is "Discernment"?

Discernment refers to a child's ability to understand that an act is wrong and appreciate its consequences. Courts determine its existence based on the circumstances of each case, including the manner of committing the offense, planning, attempts to conceal the act, and the child's conduct before, during, and after its commission.

Important to Remember
