Our lawyers’ annual retreat this year was a fitting setting to pause, reconnect, and look back on a landmark year for our firm. The journey carried special significance as we celebrate our 20th anniversary and our recognition as Law Firm of the Year 2026.

A DOSE OF LAW | More than a victim

Words shape perception. In r**e cases, “victim” has long been the default label. It names the harm accurately, but incompletely. It confines a person to the moment of abuse, defining her by the consent taken from her rather than by her choice to seek justice afterwards. The Supreme Court now acknowledges that choice.

In a recent Decision, the Supreme Court, through Associate Justice Japar B. Dimaampao, affirmed a man’s conviction for ra**ng the minor daughter of his common-law partner.

At the outset, the Court declared that, instead of the conventional “victim,” it would adopt the term “victim-survivor” — a deliberate choice of words that recognizes the harm and suffering inflicted while affirming the agency, resilience, and dignity of those who survive such violence.

DivinaLaw Associate Vincent Sierra Passes Solicitors Qualifying Examination in England and Wales

DivinaLaw Associate Atty. Vincent Mitchel N. Sierra has passed the first stage of the Solicitors Qualifying Examination (SQE) for England and Wales, placing in the top 20 percent of examinees in one of its two assessment components.

Atty. Sierra earned a Quintile 1 ranking in Functional Legal Knowledge 1 (FLK1) and Quintile 2 in Functional Legal Knowledge 2 (FLK2). Together, FLK1 and FLK2 comprise SQE1, the first of two assessment stages required for qualification as a solicitor in England and Wales.

FLK1 covers Business Law and Practice, Dispute Resolution, Contract Law, Tort, Legal System, Legal Services, and Ethics. FLK2 covers Ethics, Property Practice, Wills and Intestacy, Land Law, Trust Law, Criminal Liability, and Criminal Law and Practice.

Already licensed to practice law in the Philippines and New York, Atty. Sierra will be qualified in a third jurisdiction upon completion of the SQE, adding English law to his expertise in the Philippine and U.S. legal systems.

The qualification further strengthens DivinaLaw's capabilities in cross-border matters, including transactions governed by foreign law, and positions the Firm well as it explores establishing a presence in New York.

Can a man declared dead by a death certificate still go to court and recover possession of his property? The Supreme Court answered yes.

In a Decision penned by Chief Justice Alexander G. Gesmundo, the SC ruled that courts may pass upon the fact of a plaintiff’s death in an ejectment suit when necessary to resolve possession. Such finding is merely provisional and will not bar a subsequent action involving the same issue.

A DOSE OF LAW | Family business no more

The Constitution’s provisions are hotly debated nowadays. In the ongoing impeachment trial, senator-judges and lawyers are parsing its every word. Amid this debate, the Supreme Court has given teeth to a constitutional provision that has been ignored for far too long.

In a recent decision, the Supreme Court En Banc, through Associate Justice Ramon Paul L. Hernando, unanimously declared that Article II, Section 26 of the Constitution requires Congress to enact a law prohibiting political dynasties.

It held that Congress’ failure to do so for 39 years constitutes grave abuse of discretion.

DivinaLaw has been named Philippine Law Firm of the Year at the ALB Philippine Law Awards 2026, the highest distinction for a law firm at the annual awards. The honor, conferred on September 24, 2026 at Makati Shangri-La, coincides with the Firm's 20th founding anniversary.

The Firm also received two category awards, winning Energy and Resources Law Firm of the Year for the first time and Immigration Law Firm of the Year for the third time, after previous wins in 2018 and 2025.
