SUPREME COURT RULES THAT TAX DECLARATIONS AND LACHES CANNOT DEFEAT A TORRENS TITLE

The Supreme Court (SC) has ruled that tax declarations and the doctrine of laches cannot defeat a registered owner's Torrens title, emphasizing that the mere passage of time and payment of real property taxes do not divest a registered owner of the right to recover possession of registered land.

"A tax declaration does not prove ownership, but merely serves as an indicium of possession in the concept of ownership. A tax receipt or a declaration of ownership for taxation purposes does not constitute evidence of ownership or of the right to possess realty when not supported by other effective proofs."
