Nananatiling lehitimo ang mga anak kahit na ang kasal ng kanilang mga magulang ay idineklarang walang bisa dahil sa psychological incapacity.

Kapag naging lehitimo ang isang anak sa ilalim ng Family Code, walang legal na basehan para baguhin ang kanilang status pabalik sa illegitimate.

Ang pagpayag dito ay labag sa layunin ng batas na protektahan ang best interest ng anak.

Muling iginiit ng na nananatiling lehitimo ang mga anak kahit na ang kasal ng kanilang mga magulang ay idineklarang walang bisa dahil sa psychological incapacity.

Sa Desisyon na isinulat ni Associate Justice Jhosep Y. Lopez, binago ng Second Division ng Korte ang desisyon ng Regional Trial Court na nagdeklarang illegitimate ang isang anak kasunod ng pagpapawalang-bisa ng kasal ng kanyang mga magulang.

Ipinanganak ang bata ilang buwan bago ikinasal ang mag-asawa. Sa panahon ng kasal, ang asawang babae ay nakaranas ng pisikal, emosyonal, at berbal na pang-aabuso mula sa kanyang asawa. Ang asawang lalaki ay may isyu din ng pagkalulong sa alak, pagsusugal, at pagtataksil.

Sa petisyon na isinampa ng babae para mapawalang-bisa ang kanilang kasal, nagprisinta siya ng mga ebidensya ng pang-aabuso at isang sikolohikal na ulat na nag-diagnose sa kanyang asawa na may narcissistic personality disorder.

Pinagtibay ng Korte Suprema ang desisyon ng Regional Trial Court na walang bisa ang kasal pero nagpasya din ito na ang bata ay nananatiling lehitimo. Sa pangkalahatan, kapag ang isang kasal ay pinawalang-bisa, ang anak ay itinuturing na hindi lehitimo mula sa oras na sila ay ipinaglihi. Gayunpaman, may exception sa Family Code tulad ng kapag ang kasal ay pinawalang-bisa dahil sa psychological incapacity. Nalalapat ito kung ang bata ay ipinanganak bago o habang kasal.

Dagdag pa ng Korte, ang nawawalang anotasyon sa birth certificate ay hindi nakakaapekto sa legal na kalagayan ng anak.

Sa ilalim ng Revised Penal Code, nangyayari ang Statutory R**e kapag ang isang lalaki ay nakipagtalik sa isang batang babae na wala pang 12 taong gulang, kahit na walang kasamang puwersa, pagbabanta, o pananakot. Ang krimen ay qualified o tinataasan ang parusa kapag ang nagkasala ay isang magulang, ascendant, step-parent, guardian, relative by consanguinity o affinity within the third civil degree, o ang common-law spouse ng magulang ng biktima.

Sinabi ng Korte Suprema na ang paggamit ng mga karaniwang termino na malinaw na tumutukoy sa relasyon ay sapat na upang ipaalam sa mga akusado at panindigan ang pagiging patas at angkop na proseso.

Sa kasong ito, hayagang sinabi ng Information na ang biktima ay sariling pamangkin ni BBB. Bagama’t hindi nito tinukoy ang eksaktong antas ng kanilang relasyon, malinaw na inilarawan ang kanilang koneksyon sa ordinaryong wika.

Si BBB ay pinatawan ng pagkabilanggo hanggang 40 taon at at walang eligibility sa parole. Inatasan din siyang magbayad ng PHP 300,000 bilang danyos.

Electronic Notarization😮

The has taken an important step towards modernizing legal processes by approving the Rules on Electronic Notarization (E-Notarization Rules) – a significant reform that leverages technology to make notarial services more accessible and efficient nationwide.

Under A.M. No. 24-10-14-SC, the Supreme Court En Banc approved the E-Notarization Rules and the Guidelines on the Accreditation of Electronic Notarization Facility Providers (Accreditation Guidelines). These rules introduce Electronic Notaries Public (ENPs), who are authorized to perform notarial acts for individuals located anywhere in the Philippines and, in certain cases, even abroad.

This expanded jurisdiction addresses a key limitation of the 2004 Rules on Notarial Practice (2004 Notarial Rules), where traditional notaries public were restricted to performing notarizations only within their territorial jurisdiction. By allowing ENPs to provide services across the country, the new rules ensure greater accessibility, particularly for those in remote or underserved areas.

The updated framework enables 3 forms of electronic notarization:
- In-Person Electronic Notarization (both principals and witnesses must be physically present)
- Remote Electronic Notarization (principals and witnesses may connect virtually to ENP via videoconferencing)
- Mixed In-Person and Remote

To enhance security, the E-Notarization Rules implements Multi-Factor Authentication (MFA) such as facial recognition, biometrics, and one-time passwords, in compliance with regulations set by the Bangko Sentral ng Pilipinas. The integrity of the electronic notarial book, or the register showing the chronological record of electronic notarial acts, is also safeguarded against tampering. Additionally, all data stored in the ENFs are protected under the Data Privacy Act.

The E-Notarization Rules applies exclusively to electronic documents in Portable Document Format (PDF) or Portable Document Format Archival (PDF/A). Paper documents with handwritten signatures, notarial wills, and depositions will continue to follow the 2004 Notarial Rules.

A part of the Strategic Plan for Judicial Innovations 2022-2027 (SPJI), this initiative aligns with the Supreme Court’s commitment to innovation and expanded access to justice by allowing notarization for electronic documents, including remote notarization through accredited software applications. This reform supplements the traditional mode of notarization under the 2004 Notarial Rules and marks a key milestone in the Court’s ongoing digital transformation.

The E-Notarization Rules takes effect 15 days after its publication on March 9, 2025.
