JUSTICE LEONEN QUESTIONS CONGRESS OVER SHIFT OF PROGRAMMED PROJECTS TO UNPROGRAMMED ALLOCATIONS
Senior Associate Justice Marvic Leonen, during the oral arguments on the petition questioning the constitutionality of unprogrammed appropriations, raised concerns over Congress’s practice of transferring programmed projects to unprogrammed allocations even when these are already identified as priorities under the National Expenditure Program of the executive.
To address this issue and guide the Court in resolving the case, Leonen directed Solicitor General Darlene Marie Berberabe to submit documents relating to projects funded through unprogrammed appropriations in the 2024 and 2025 national budgets, including the corresponding certifications of excess funds issued by the Bureau of the Treasury.
