PNP members acting as bodyguards for a private person without proper authority constitute Serious Irregularities in the Performance of Duties.

Under PNP Memorandum Circular No. 93-024, acting as a bodyguard or security guard for a private person without approval of the proper authorities constitutes a grave offense.

The Court held that the complainants' positive identification was entitled to greater weight than the respondent's denial and unsupported alibi.

CYBER LIBEL: 1 year prescriptive period.

In Berteni Cataluña Causing v. People of the Philippines (G.R. No. 258524),

The Supreme Court En Banc ruled that cyber libel prescribes in one year, measured from the offended party's actual discovery of the post, rather than from the date of posting. The ruling clarifies that cyber libel falls under the one-year prescriptive period of the Revised Penal Code and reaffirms that unsigned minute resolutions do not create binding legal precedent.

Pinagtibay ng Korte Suprema En Banc na ang cyber libel ay may isang (1) taong prescriptive period, na nagsisimulang bilangin mula sa aktuwal na pagkakadiskubre ng nakasasakit na post ng taong naagrabyado, at hindi mula sa petsa kung kailan ito nai-post.

Nilinaw rin ng Korte na ang cyber libel ay saklaw ng isang taong prescriptive period sa ilalim ng Revised Penal Code. Bukod dito, muling pinagtibay ng Korte na ang mga unsigned minute resolution ay hindi bumubuo ng umiiral at nagbubuklod na legal na precedent (binding legal precedent).

EXTRADITION:

Ang Extradition ay ang pormal na proseso kung saan isinusuko ng isang bansa ang isang taong inaakusahan o nahatulan ng krimen sa ibang bansa upang doon siya litisin o parusahan.

Mga Pangunahing Prinsipyo:

Double Criminality – Ang ginawa ay dapat na krimen sa parehong bansa.

Specialty – Ang taong na-extradite ay maaari lamang litisin sa kasong nakasaad sa kahilingan.

Treaty Basis – Dapat may umiiral na extradition treaty o kasunduan sa pagitan ng mga bansa.

Proseso ng Extradition:

Kahilingan – Nagsusumite ang humihiling na bansa ng pormal na aplikasyon at mga dokumento.

Pagsusuri – Sinusuri ng awtoridad (hal. Department of Justice) kung kumpleto at naaayon sa batas ang kahilingan.

Pagpapasya ng Hukuman – Tinutukoy ng hukuman kung maaaring ipa-extradite ang hinihinging tao alinsunod sa batas at sa kasunduan ng mga bansa.

The SUPREME COURT clarified that a police officer cannot be held administratively liable for failing to record unverified or disproved incidents in the police blotter. The court clarified that a police blotter is a record of verified, actual events, not a diary for unsubstantiated claims.

A police blotter is a book which records criminal incidents reported to the police. It "contains the daily registry of all crime incident reports, official summaries of arrest, and other significant events reported in a police station. Jurisprudence holds that entries in the police blotter should not be given undue significance or probative value as they are not evidence of the truth of their contents but merely of the fact that they were recorded. Such entries are usually incomplete and inaccurate, sometimes from either partial suggestions or for want of suggestions or inquiries.

A police blotter is not a minutes of the events that happened within the four corners of a police station. Neither is it a journal that records whatever any person desires to be recorded. As an official police document, a police blotter must only contain the matters which are provided for in its definition – criminal incidents, official summaries of arrest, and other significant events reported to the police.

The Court finds it difficult to sanction petitioner for not recording in the police blotter a mauling incident which, as far as the records show, never occurred. And assuming arguendo that respondent was indeed severely rebuked or castigated inside the police station, the same does not automatically constitute a criminal incident or a related significant event that must be recorded in a police blotter.

SUPREME COURT ruled that a traffic violation or minor ordinance infraction does not justify a warrantless search.

Ang Korte Suprema ay nagpasiya na ang paglabag sa trapiko o maliit na paglabag sa ordinansa ay hindi sapat na dahilan para sa paghahanap nang walang search warrant.
