The Bureau of Internal Revenue (BIR), through Revenue Memorandum Circular (RMC) No. 95-2026, has further extended to August 18, 2026, the specified tax filing, payment, remittance, registration, and submission deadlines for taxpayers in Habagat-affected areas previously covered by RMC No. 89-2026. The new Circular also expands the extension to taxpayers affected by the technical unavailability of the eBIRForms Offline Package.

For taxpayers covered by RMC No. 89-2026, the specified deadlines previously extended to August 17 are moved one more day to August 18.

Taxpayers affected by the eBIRForms technical issues are likewise given until August 18 to comply with the specified obligations covered by RMC 95-2026, without the corresponding penalties.

โ€œWe recognize the difficulties faced by taxpayers affected by the rains, as well as those who are unable to comply because of the technical issues with eBIRForms. We are giving them additional time to complete their tax obligations without penalty,โ€ Commissioner Charlito Martin R. Mendoza said.

The extension covers specified filing, payment, remittance, and submission requirements originally due from August 10 to 16, 2026, including applicable withholding tax returns, income tax returns, ONETT transactions, and other obligations enumerated in the Circular.

The BIR has likewise issued a Bank Bulletin directing Authorized Agent Banks (AABs) to accept covered tax returns and payments until August 18, 2026, without the corresponding penalties, from both taxpayers covered by the Habagat-related extension and those affected by the unavailability of the eBIRForms Offline Package.

The BIR clarified that taxpayers mandated to use the Electronic Filing and Payment System (eFPS) who are not covered by RMC No. 89-2026 are not included in the extension and must continue to use eFPS to file their returns and pay taxes due.

โ€œWe remind covered taxpayers to complete their filing and payment requirements by August 18. At the same time, we assure taxpayers that when circumstances beyond their control make compliance difficult, the BIR will continue to respond reasonably and give them a fair opportunity to comply,โ€ Commissioner Mendoza said.

When a foreign citizen is named as a beneficiary of Philippine land, it's a common assumption that it is completely illegal due to strict ownership rules in the Constitution.

While the general rule strictly protects Philippine real estate from foreign ownership, Philippine law actually contain a critical exception specifically designed for family inheritance situations.

Under Philippine law, foreign nationals are prohibited from acquiring private land.

Foreigners cannot purchase property, receive land as a gift, or acquire land through nominee arrangements. The law protects national patrimony by ensuring that land ownership stays in Filipino hands.

Despite this general prohibition, the Constitution explicitly allows foreign citizens to acquire land under one specific condition: hereditary succession.

This means if a foreign national is an heir under Philippine law, such as a child, foreign spouse, or immediate relative acquiring property when someone passes away, the transfer of land is legally valid.

There is a vital legal distinction that every family must understand regarding how the land is passed down.

The exception for hereditary succession applies strictly to intestate succession (inheritance by operation of law without a will) or to compulsory heirs receiving their legal share.

A foreigner cannot simply be given land through a last will and testament if they are not a legal compulsory heir. The law prevents individuals from using a will as a workaround to transfer property to non-heir foreign citizens.

Foreign spouses, foreign-born children, or relatives who hold non-Philippine passports can legally own inherited land through intestate settlement.

Understanding these inheritance boundaries ensures that family properties are settled properly without violating national property restrictions.

A lot of property buyers in the Philippines โ€” especially in the provinces โ€” are offered land with only a Tax Declaration and no Torrens Title. The price is tempting. The seller seems legit. So you pay up.

But here's the problem: you might be paying for something that was ๐˜ฏ๐˜ฆ๐˜ท๐˜ฆ๐˜ณ legally theirs to sell.

Under Philippine law, ownership of real property is established through the Torrens system โ€” meaning a Certificate of Title (OCT or TCT) issued by the Register of Deeds. This is governed by Presidential Decree No. 1529, also known as the Property Registration Decree.

A Tax Declaration? It's issued by your local assessor's office It identifies who's paying real property tax โ€” but it does NOT prove ownership. The Supreme Court has said this repeatedly. (G.R. No. 195726), the Court held that tax declarations and receipts are not conclusive evidence of ownership. In the ๐˜Š๐˜ฆ๐˜ฒ๐˜ถ๐˜ฆ๐˜ฏ๐˜ข ๐˜ข๐˜ฏ๐˜ฅ ๐˜“๐˜ช๐˜ณ๐˜ช๐˜ฐ case, the Court echoed the same โ€” they are merely ๐˜ช๐˜ฏ๐˜ฅ๐˜ช๐˜ค๐˜ช๐˜ข of a claim.

1. Someone else may hold a Torrens Title over the same land โ€” and between a Tax Declaration and a Title, ๐˜ต๐—ต๐—ฒ ๐—ง๐—ถ๐˜๐—น๐—ฒ ๐˜„๐—ถ๐—ป๐˜€. Every time. You could lose everything.

2. Multiple people can hold overlapping Tax Declarations on the same parcel. Pamilya ng seller, kapit-bahay, or even a stranger โ€” lahat pwedeng nag-declare.

3. Hidden liens, unpaid mortgages, or legal disputes won't show up on a Tax Declaration the way they would on a registered Title with annotations.

4. Banks won't accept it as collateral. So forget about using that property for a housing loan or mortgage.

5. The land might still be classified as public domain โ€” forest land or a protected area under DENR. If so, ๐˜ช๐˜ต ๐˜ค๐˜ข๐˜ฏ๐˜ฏ๐˜ฐ๐˜ต ๐˜ฃ๐˜ฆ ๐˜ญ๐˜ฆ๐˜จ๐˜ข๐˜ญ๐˜ญ๐˜บ ๐˜ด๐˜ฐ๐˜ญ๐˜ฅ at all.

If you buy land with only a Tax Declaration, you'll eventually need to secure a proper Title through either judicial or administrative titling. That means: hiring a geodetic engineer for a land survey, filing an application with DENR or a Regional Trial Court, paying for publication notices, legal fees, and government charges โ€” and waiting anywhere from 1 to 5 years for the process to finish, depending on complexity and court availability.

It's not really cheap. And it's never done quick.

โœ…

Before buying any property, do these things:

Check the Registry of Deeds to confirm whether a Torrens Title already exists for that parcel.
Visit the DENR to verify if the land is classified as alienable and disposable.
Get a certified true copy of the Tax Declaration from the Assessor's Office.
Hire a licensed geodetic engineer to verify boundaries and check for overlapping claims.
Consult a real estate lawyer.

The bottom line: a Tax Declaration is ๐˜ฏ๐˜ฐ๐˜ต a Title. It doesn't document ownership. If you're spending your hard-earned money on property, make sure you're actually getting what you're paying for.
