SC Acquits Husband in VAWC Case, Rules Denial of Financial Support Must Be Willful and Intended to Cause Psychological Harm

The case arose from an Amended Information alleging that the accused abandoned his wife and denied her financial support from 2004 onward, thereby causing her mental and emotional anguish.

The Decision reversed and set aside the CA ruling.

The Court stressed that the term “denial” connotes willfulness and active refusal. It is distinct from mere “failure” or inability to provide support. Being a crime mala in se, there must be concurrence of actus reus and mens rea.

Naglabas ang ng mga gabay sa pagpapatunay ng pagkakakilanlan ng may-ari o gumagamit sa isang 𝘴𝘰𝘤𝘪𝘢𝘭 𝘮𝘦𝘥𝘪𝘢 𝘢𝘤𝘤𝘰𝘶𝘯𝘵 sa mga kasong kriminal.

Sa Desisyon na isinulat ni Associate Justice Ramon Paul L. Hernando, pinagtibay ng Unang Dibisyon ng Korte Suprema ang hatol sa isang indibidwal (###) dahil sa nagawa nitong psychological violence sa ilalim ng Section 5 (i) ng 𝘈𝘯𝘵𝘪-𝘝𝘪𝘰𝘭𝘦𝘯𝘤𝘦 𝘈𝘨𝘢𝘪𝘯𝘴𝘵 𝘞𝘰𝘮𝘦𝘯 𝘢𝘯𝘥 𝘛𝘩𝘦𝘪𝘳 𝘊𝘩𝘪𝘭𝘥𝘳𝘦𝘯 (𝘈𝘯𝘵𝘪-𝘝𝘈𝘞𝘊) 𝘈𝘤𝘵 laban sa dating kasintahan (AAA) sa pamamagitan ng mapanlait na 𝘱𝘰𝘴𝘵 sa 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬.

Hinatulan si ### ng hanggang walong taong pagkakakulong at pinagmumulta ng PHP 100,000. Ipinag-utos din nitong sumailalim si ### sa 𝘱𝘴𝘺𝘤𝘩𝘰𝘭𝘰𝘨𝘪𝘤𝘢𝘭 𝘤𝘰𝘶𝘯𝘴𝘦𝘭𝘪𝘯𝘨 o 𝘱𝘴𝘺𝘤𝘩𝘪𝘢𝘵𝘳𝘪𝘤 𝘵𝘳𝘦𝘢𝘵𝘮𝘦𝘯𝘵.

Binigyang-diin ng Korte na sa mga kasong kriminal, dapat patunayan ng prosekusyon hindi lamang ang mga elemento ng krimen kundi pati na rin ang pagkakakilanlan ng nagkasala.

Sa mga krimeng ginawa sa pamamagitan ng social media, sabi ng Korte, kailangang isaalang-alang ang mga katangian ng platform gaya ng 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬. Paliwanag ng Korte, madaling makagawa ng 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬 𝘢𝘤𝘤𝘰𝘶𝘯𝘵 sa Pilipinas, kahit ang mga nagpapanggap na labintatlong taong gulang na may 𝘦𝘮𝘢𝘪𝘭 𝘢𝘥𝘥𝘳𝘦𝘴𝘴 at 𝘮𝘰𝘣𝘪𝘭𝘦 𝘯𝘶𝘮𝘣𝘦𝘳. Dahil sa mga pekeng 𝘢𝘤𝘤𝘰𝘶𝘯𝘵, madali ring kumalat ang pekeng impormasyon, pagnanakaw ng pagkakakilanlan, o krimen.

Para matukoy ang pagmamay-ari o pagkakakilanlan ng may hawak ng 𝘴𝘰𝘤𝘪𝘢𝘭 𝘮𝘦𝘥𝘪𝘢 𝘢𝘤𝘤𝘰𝘶𝘯𝘵, kailangan patunayan ang alinman sa mga sumusunod:

1. Pag-amin ng pagmamay-ari o pagiging may-akda;
2. May nakakitang ginagamit ang account o sinusulat ang 𝘱𝘰𝘴𝘵;
3. Paglalaman ng impormasyon na alam lang ng nagkasala o ng iilang tao;
4. Lenggwaheng naaayon sa katangian ng maysala;
5. Mga rekord mula sa 𝘪𝘯𝘵𝘦𝘳𝘯𝘦𝘵 𝘴𝘦𝘳𝘷𝘪𝘤𝘦 𝘱𝘳𝘰𝘷𝘪𝘥𝘦𝘳, 𝘵𝘦𝘭𝘦𝘤𝘰𝘮𝘮𝘶𝘯𝘪𝘤𝘢𝘵𝘪𝘰𝘯𝘴 𝘤𝘰𝘮𝘱𝘢𝘯𝘺, o 𝘴𝘰𝘤𝘪𝘢𝘭 𝘮𝘦𝘥𝘪𝘢 𝘴𝘪𝘵𝘦, at mga resulta sa 𝘥𝘦𝘷𝘪𝘤𝘦 𝘧𝘰𝘳𝘦𝘯𝘴𝘪𝘤 𝘢𝘯𝘢𝘭𝘺𝘴𝘪𝘴 na nagpapakita ng lokasyon at iba pang katangiang nag-uugnay sa 𝘢𝘤𝘤𝘰𝘶𝘯𝘵 sa maysala;
6. Mga kilos na naaayon sa mga dating 𝘱𝘰𝘴𝘵; o
7. Iba pang mga bagay na nagpapakita ng pagmamay-ari, pag-access o pagiging may-akda.

Gamit ng mga gabay na ito, napatunayan ng Korte na may ilang elemento nagpapakita na si ### ang nagsulat ng 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬 𝘱𝘰𝘴𝘵. Buong pangalan niya ang nasa 𝘢𝘤𝘤𝘰𝘶𝘯𝘵 𝘯𝘢𝘮𝘦 at kasama niya sa 𝘱𝘳𝘰𝘧𝘪𝘭𝘦 𝘱𝘩𝘰𝘵𝘰 ang anak niya sa kanyang kasalukuyang kinakasama.

Nakatanggap din ang kapatid ni AAA ng mga mensahe mula sa kaparehong 𝘢𝘤𝘤𝘰𝘶𝘯𝘵 sa loob ng ilang taon. Magkapareho ang sitwasyon ng mga mensahe na nagtuturo kay ### bilang siyang gumagamit ng 𝘢𝘤𝘤𝘰𝘶𝘯𝘵.

Sinuspinde o pinagpaliban muna ng ang hatol sa isang child in conflict with the law (CICL), bilang paggiit sa layunin ng Republic Act No. (RA) 9344, o ang Juvenile Justice and Welfare Act, na isulong ang pinakamahusay na interes at rehabilitasyon ng bata.

Sa isang Desisyon na isinulat ni Associate Justice Mario V. Lopez bago siya magretiro, tinanggihan ng En Banc ng Korte Suprema ang apela ni ###265302 (akusado) na napatunayang nagkasala ng qualified r**e ng isang menor de edad. Napatawan siya ng parusang 12 taon hanggang 14 na taon, walong buwan at isang araw sa bilangguan.

Ibinalik ang kaso sa Regional Trial Court (RTC) para ipag-utos na madetine ang akusado sa isang agricultural camp o iba pang pasilidad ng pagsasanay sa ilalim ng Section 51 ng batas.

Kinasuhan ng panggagahasa sa kanyang limang taong gulang na kalaro ang akusado na 15 taong gulang nang mangyari ang krimen.

Labing-walong taong gulang na siya nang hatulan ng Regional Trial Court (RTC) na guilty sa statutory r**e. Ipinataw nito ang parusang pagkakakulong ng walong taon at isang araw hanggang 14 na taon, walong buwan at isang araw, ngunit sinuspinde ng RTC ang kanyang sentensiya.

Sa ilalim ng Section 38 ng RA 9344, may karapatan sa suspensiyon ng kanilang sentensiya ang isang akusado na menor de edad sa panahon ng pagkakasala.

Makalipas ang ilang buwan, naglabas ang RTC ng warrant of arrest, at siya ay ikinulong sa New Bilibid Prison. Tinanggihan ng Court of Appeals ang kanyang apela.

Pinagtibay ng Korte Suprema ang kanyang hatol ngunit nilinaw na ang krimen ay qualified r**e at ipinag-utos ang suspensiyon ng kanyang sentensiya.

Nakasaad sa Section 40 ng RA 9344 na kapag nasa edad 18 ang CICL habang nasa ilalim ng nasuspinding sentensiya, maaari silang palayain ng korte, iutos na ipatupad ang kanilang sentensiya, o palawigin ang suspendidong sentensiya sa loob ng isang panahon o hanggang umabot sila sa maximum na edad na 21 taong gulang.

Sa kasong ito, 25 taong gulang na ngayon ang akusado na inilipat sa Davao Prison and Penal Farm.

Gayunpaman, pinahaba ng Korte Suprema ang pagsuspinde sa kanyang sentensiya para matupad ang layunin ng batas na inuuna ang pagpapanumbalik, rehabilitasyon, at reintegrasyon ng mga batang nagkasala sa komunidad.
