Mahirap ba ang proseso ng pagta-transfer ng title?

Kung ikaw ay nagbabalak bumili ng lupa, bahay, o anumang property, ang tanong na ito ang madalas nakakabagabag. Kung hindi mo pa ito na-experience, baka akala mo parang thesis defense ang prosesoโ€”pero promise, hindi ganun kahirap kapag alam mo ang tamang mga steps! ๐Ÿ’ก

1. Siguraduhing kompleto ang dokumento
โœ… Deed of Sale
โœ… Tax Declaration
โœ… Clearance (BIR at LGU) etc.

2. Magbayad ng tamang buwis
Alam mo ba na kailangan mo munang magbayad ng Capital Gains Tax (CGT) at Documentary Stamp Tax (DST) bago mo maituloy ang transfer? Oo, may bayaran, pero isipin mo nalang na ito ang entrance fee para sa sarili mong property.

3. Maglakad ng mga papeles sa Registry of Deeds
Pumila, maghintay, at wag kalimutang magdala ng extra snacks. ๐Ÿฅช Pero teka, hindi mo naman kailangang gawin โ€˜to mag-isa. Pwede kang magpatulong sa eksperto na kagaya ng aming team ๐Ÿ˜‡

4. Maghintay.

Excited ka bang bumili ng Bahay o kahit anong property? Wait lang! Bago ka sumabak sa pagbili, kailangan mong malaman ang mga tax na kaakibat nito. Bakit? Kasi hindi lang presyo ng bahay ang kailangang bayaranโ€”may mga dagdag na gastos na dapat paghandaan para smooth ang proseso at legal ang paglipat ng property sa pangalan mo.
So, ano-ano nga ba ang mga tax na dapat mong alamin?

1. ๐™๐™ง๐™–๐™ฃ๐™จ๐™›๐™š๐™ง ๐™๐™–๐™ญ
Ito ang bayad para mailipat ang pagmamay-ari ng property mula sa seller papunta sa iyo. Parang bayad ito sa gobyerno para ma-certify na ikaw na talaga ang bagong may-ari. Ang halaga nito? Depende sa presyo ng propertyโ€”karaniwang nasa 0.5% hanggang 0.75% ng halaga ng bahay o lupa.

2. ๐˜ฟ๐™ค๐™˜๐™ช๐™ข๐™š๐™ฃ๐™ฉ๐™–๐™ง๐™ฎ ๐™Ž๐™ฉ๐™–๐™ข๐™ฅ ๐™๐™–๐™ญ (๐˜ฟ๐™Ž๐™)
Kapag bumili ka ng property, kailangan ng stamp para sa legal na dokumento. Ang Documentary Stamp Tax ay 1.5% ng property value o zonal value (alinman ang mas mataas). Oo, parang maliit lang, pero kapag malaki ang presyo ng bahay, lalaki rin ito.

3. ๐™๐™š๐™œ๐™ž๐™จ๐™ฉ๐™ง๐™–๐™ฉ๐™ž๐™ค๐™ฃ ๐™๐™š๐™š
Pagkatapos maipasa ang pagmamay-ari, kailangan mong ipa-update ang titulo ng property para sa pangalan mo. Ito ang ginagawa sa Land Registration Authority (LRA), at dito binabayaran ang Registration Fee.

4. ๐™๐™š๐™–๐™ก ๐™‹๐™ง๐™ค๐™ฅ๐™š๐™ง๐™ฉ๐™ฎ ๐™๐™–๐™ญ (๐™๐™‹๐™)
Ito naman ang buwis na binabayaran taun-taon para sa pagmamay-ari ng property. Parte ito ng local government revenue para sa mga serbisyo gaya ng kalsada, streetlights, at iba pang proyekto. Kahit tapos ka nang bumili, regular na bayarin pa rin ito na dapat mong tandaan.

May balak ka bang bumili ng lupa, ngunit nakita mong may Lis Pendens ito? Bago ka magdesisyon, alamin muna kung ano ang Lis Pendens at paano ito makakaapekto sa iyong pagbili.

Ano ang Lis Pendens?

Ang Lis Pendens ay salitang latin, sa Ingles ay "Pending Litigation" at sa tagalog naman ay nakabinbing kaso. Nangangahulugan ito na may kasalukuyang kaso o legal na usapin na may kinalaman sa isang property. Ibig sabihin, may isyu na dapat resolbahin bago tuluyang maging klaro ang pag-aari ng lupa o bahay na nais mong bilhin.

Paano Nakakaapekto ang Lis Pendens sa Pagbili?

Kapag may Lis Pendens ang isang property, may panganib na magkaruon ng problema sa titulo ng lupa at magulat ka na may umaangkin ng iyong property. Maaaring magkaroon ng mga legal na problema na makakaapekto sa iyong karapatan bilang bagong may-ari.

Safe Bang Bilhin?

Hindi ibig sabihin na hindi mo na kayang bilhin ang lupa. Kung nais mo talagang ituloy, mahalaga ang pag-iingat at tamang hakbang.
