⚖️ LEGAL EXPLAINER: The Impeachment Trial of VP Sara Duterte — What Happens on July 6?

1. Unsa ang Impeachment?
Impeachment is not a criminal trial. It is a political process under Article XI of the 1987 Constitution to remove impeachable officials including the Vice President for culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust. The penalty is limited to removal from office and disqualification to hold any public office. Separate criminal or civil cases may still follow.
2. Asa na ta karon sa proseso?
The two-stage process works like this: the House of Representatives impeaches (files the charges), and the Senate tries and decides. The House impeached VP Duterte for the second time on May 11, 2026, with 257 lawmakers voting in favor, 25 against, and 9 abstentions. The Articles of Impeachment were transmitted to the Senate on May 13.
3. The Four Articles of Impeachment
Article I — misuse of up to ₱612.5 million in confidential funds from the OVP and DepEd; Article II — unexplained wealth disproportionate to her lawful income; Article III — bribery, graft, and corruption; and Article IV — her public admission of contracting someone to kill President Marcos, the First Lady, and former Speaker Romualdez.
4. The Senate as Impeachment Court
The Senate formally convened as an impeachment court on May 18, 2026. The 24 senators sit as judges, the House panel acts as prosecutors, and VP Duterte is the respondent with her defense team. A pretrial conference now presided over by Senate President Sherwin Gatchalian was held to mark evidence, list witnesses, and streamline the proceedings, similar to pretrial in criminal cases.
5. The Schedule
Trial hearings will run every Monday, Tuesday, and Wednesday at 2 p.m. beginning July 6, 2026, with the pre-trial order targeted for release before June 25.
6. The Critical Number: 16
Para ma-convict, two-thirds of all Senate members must vote against her. At least 16 of the 24 sitting senators must vote to convict on any impeachable offense for her to be removed from office and permanently disqualified from holding public office. If the vote falls short, she is acquitted.
7. Why It Matters
This is more than politics. A conviction would permanently bar VP Duterte from holding public office with major implications for the 2028 elections. Beyond personalities, this trial tests the strength of our constitutional mechanisms of accountability and the rule of law.
