Impeachment? How initiated?
“Endorse by any CONGRESSMAN” is the KEY

Article XI Section 3

Section 3. The House of Representatives shall have the exclusive power to initiate all cases of impeachment.

A verified complaint for impeachment may be filed by any Member of the House of Representatives or by any citizen upon a resolution or endorsement by any Member thereof,

which shall be included in the Order of Business within ten session days, and referred to the proper Committee within three session days thereafter. The Committee, after hearing, and by a majority vote of all its Members, shall submit its report to the House within sixty session days from such referral, together with the corresponding resolution. The resolution shall be calendared for consideration by the House within ten session days from receipt thereof.

As the bar exam results was out and we now have new lawyers, can we advocate to be a christian lawyers so that lawyers will go through the spirit of the law, and use it to serve justice, help and protect rights of individuals. And NOT to use the letters of the law to cirvumvent, to do injustice and worst to bend the law.

48.98% at 5,594 out of 11,425 new lawyers

The Supreme Court has released the results of the 2025 Bar Examinations.

Bar Chairperson Justice Amy Lazaro-Javier said that out of the 11,425 Bar takers last September 2025, only 5,594 passed with a passing rate of 48.98%.

The Supreme Court en Banc approved a passing grade of 75%. Lazaro-Javier also disclosed that the oath-taking and roll signing would be on February 6, 2026.

How to know when a witness is NOT telling the truth

These are the red flags to watch out for:

1. Self-preservation. A person under investigation will always look for a bigger "villain" to shift the blame and dilute his own liability.

2. Playing the victim. Claims of threats and fear for life are convenient shields when accountability is closing in.

3. Too good to be true. The narrative is so perfectly packaged for maximum shock value that it raises more doubts than clarity.

4. Suspicious timing. Is the goal truth, or to fuel the momentum of unrest? Courage, or choreography?

5. Statements with little to no corroboration. Until allegations are supported by documents, credible witnesses, and tested under cross-examination, they remain just allegations.

6. Claims that contradict logic. If a person insists that a powerful figure masterminded an anomaly, but that same figure was the one who exposed it, froze the projects, and demanded an investigation, it makes no sense.

7. Selective storytelling. The witness shares only the parts that make him look innocent.

8. Overemphasis on “I have nothing to gain.” This is a witness who insists he's just doing the right thing but is obviously benefiting from the chaos.

9. Sudden moral awakening. Watch out for people who profit from the system and then suddenly “wake up” only when they are cornered.

10. “I didn’t receive a single cent.” This contradiction alone makes the story crumble.

11. Staying abroad and refusing to come home. Flight is an indication of guilt.

LOSS OF TRUST and CONFIDENCE as a valid ground for termination of employment.

The Philippine Supreme Court recognizes loss of trust and confidence as a valid ground for terminating employment, but with specific requirements and limitations.

Here's a breakdown:

• Requirements for valid termination:

◦ The loss of trust must be based on a willful breach of trust by the employee. The breach must be done intentionally, knowingly, and purposely, without justifiable excuse.

◦ The loss of trust must be based on substantial evidence and not on the employer's whims or suspicions.

◦ The act complained of must be work-related and demonstrate that the employee is unfit to continue working for the employer.

◦ The employee must hold a position of trust and confidence.

• Managerial vs. Rank-and-File Employees:

◦ The dismissal of a managerial employee based on loss of trust is generally easier to justify than that of a rank-and-file employee. The law grants employers wider latitude when dealing with managerial employees because their roles demand utmost fidelity.

◦ For managerial employees, proof beyond reasonable doubt is not required. What is needed is a genuine and reasonable basis for the employer to believe that the employee has breached their trust.

• Due Process:

◦ Even high-ranking employees are entitled to due process and fair dealing.

• Examples from Supreme Court Cases:

◦ In one case, the Supreme Court declared the termination of a managing director invalid because it rested on unsubstantiated claims. The employer failed to identify any specific act that eroded trust.

◦ In another case, the dismissal of a shift superintendent in a power plant was upheld because he failed to report a subordinate's misconduct.

• Key Considerations:

◦ Employers cannot rely on broad accusations or generalized dissatisfaction.

◦ Management prerogatives must never be exercised arbitrarily. Dismissal affects not only livelihood but also dignity.

In summary, while loss of trust and confidence is a valid ground for termination, it must be exercised with fairness, good faith, and due regard for evidence. The specific facts and circumstances of each case are critical in determining the validity of the termination
