TWO CASES DISMISSED ⚖️
I am pleased to share another favorable resolution for a client involving two separate cases filed before the Office of the Ombudsman – Mindanao:
1. Violation of Section 3(e) of R.A. No. 3019 (Anti-Graft and Corrupt Practices Act); and
2. Conduct Unbecoming of a Public Official and Grave Misconduct.
After evaluation of the evidence, the Office of the Ombudsman found that the evidence did not reasonably establish manifest partiality, evident bad faith, or gross inexcusable negligence. Neither was there sufficient proof of undue injury or any unwarranted benefit or advantage contemplated by law.
The Joint Resolution ultimately ruled:
“WHEREFORE, the cases are dismissed.”
The seriousness of an accusation does not take the place of proof. Every case must stand on the evidence and the law.
