SQUATTERS BUILT A HOUSE ON YOUR LAND. CAN YOU DEMAND ITS DEMOLITION?
Imagine you own a substantial parcel of land. Someone enters the property without your permission, constructs a house, and refuses to leave.
You discover the structure only after it has been built. The occupants insist on staying.
What can you do? Can you demand demolition? What if the builder knew the land belonged to someone else?
THINK AGAIN.
Before taking action, have you considered these questions?
• What evidence could help establish that the occupants knew they were building on someone else's land?
• Does the builder's knowledge of the ownership dispute matter?
• Can the landowner demand removal or demolition of the structure?
• Who may have to shoulder the cost of demolition?
• What if the landowner knew about the construction but did not object?
• What if the occupants claim that they spent substantial money building the house?
• What if the land is worth millions, and the dispute threatens its development or sale?
• Should the landowner act before the structure is completed?
BUILDER IN BAD FAITH. SQUATTERS. DEMOLITION. RECOVERY OF LAND.
These issues can become more complicated when the property involves a substantial landholding, a commercial development, an inherited estate, or land intended for investment.
Would you risk acting without first examining the evidence, the construction history, the ownership documents, and the available legal remedies?
DUE DILIGENCE AND EVIDENCE MATTER.
Reading relevant legal materials can help you prepare informed questions for your own lawyer. Would you know what evidence to preserve, what facts to establish, and what remedies to discuss before taking action?
