On Hospital Detention

A patient may leave the hospital even if his/her bills remain unsettled provided that a promissory note, secured by either a mortgage or by a guarantee of a comaker, be executed covering the unsettled hospital bills. Note, however, that the that patients who stayed in private rooms shall not be covered by RA 9436.

Republic Act (RA) 9436, otherwise known as the "Act Prohibiting the Detention of Patients in Hospitals and Medical Clinics on Grounds of Nonpayment of Hospital Bills or Medical Expenses, expressly provides:

"SECTION 1. It shall be unlawful for any hospital or medical clinic in the country to detain or to otherwise cause, directly or indirectly, the detention of patients who have fully or partially recovered or have been adequately attended to or who may have died, for reasons of nonpayment in part or in full of hospital bills or medical expenses."

Online harassment

The act of a person of posting photos without the consent of the owner of such photo may constitute Gender-Based Online Sexual Harassment as defined and penalized by the "Safe Spaces Act."

Republic Act (RA) 11313 or the "Safe Spaces Act." Section 12 of RA 11313 expressly states, that:

"Section 12. Gender-Based Online Sexual Harassment. - Gender-based online sexual harassment includes acts that use information and communications technology in terrorizing and intimidating victims through physical, psychological, and emotional threats, unwanted sexual misogynistic, transphobic, homophobic and sexist remarks and comments online whether publicly or through direct and private messages, invasion of victim's privacy through cyberstalking and incessant messaging, uploading and sharing without the consent of the victim, any form of media that contains photos, voice, or video with sexual content, any unauthorized recording and sharing of any of the victim's photos, videos, or any information online, impersonating identities of victims online or posting lies about victims to harm their reputation, or filing, false abuse reports to online platforms to silence victims."

Relative thereto, Section 14 thereof also provides for a penalty, to wit:

"Section 14. Penalties for Gender-Based Online Sexual Harassment. -The penalty of prision correccional in its medium period or a fine of not less than One hundred thousand pesos (P100,000.00) but not more than Five hundred thousand pesos (P500,000.00), or both, at the discretion of the court shall be imposed upon any person found guilty of any gender-based online sexual harassment."

An accused has in his favor the presumption of innocence which the Bill of Rights guarantees. Unless his guilt is shown beyond reasonable doubt, he must be acquitted. This reasonable doubt standard is demanded by the due process clause of the Constitution which protects the accused from conviction except upon proof beyond reasonable doubt of every fact necessary to constitute the crime with which he is charged. The burden of proof is on the prosecution, and unless it discharges that burden the accused need not even offer evidence on his behalf, and he would be entitled to an acquittal. Proof beyond reasonable doubt does not, of course, mean such a degree of proof as, excluding the possibility of error, produces absolute certainty. Moral certainty only is required, or that degree of proof which produces conviction in an unprejudiced mind. The conscience must be satisfied that the accused is responsible for the offense charged (People v. Ganguso)
