POV: You are fighting a criminal case.

The prosecutor investigates, finds probable cause, and files the official criminal chargeโ€”the Informationโ€”in court. Later, you appeal to the Department of Justice (DOJ).

The DOJ Secretary reviews the file, reverses the prosecutor, and declares, "There is no case here; withdraw the charges immediately!"

You assume you are free.

But when the prosecutor goes to court to drop the case, the judge says, "Not so fast. I will decide whether to dismiss this case or not."

This is exactly what happened in the landmark case of Crespo v. Mogul.

The Supreme Court ruled that once a criminal case is filed in court, the executive branch loses its exclusive control over its disposition. The prosecutor cannot simply walk into court and take the case back. The fate of that caseโ€”whether it gets dismissed, or whether you get convicted or acquittedโ€”rests entirely within the sound discretion of the trial judge.

The prosecutor owns the door to the courthouse, but the judge rules the house.
