إذا كنت بائعًا أو مشتريًا وتواجه اختلافًا في الكمية أو الصنف بين ما تم الاتفاق عليه وما تم تسليمه، فهناك بعض النقاط المهمة التي يجب أن تعرفها:

📌 إذا كانت البضاعة تختلف عن المتفق عليه:
• المشتري لا يستطيع طلب فسخ العقد إلا إذا كان الاختلاف مؤثرًا بشكل كبير لدرجة أن البضاعة أصبحت غير صالحة للغرض المقصود.

📜 المطالبة بالفواتير والديون

يحق للدائن المطالبة بالفواتير المستحقة ولكن يجب عليه أن يراعي عدة نقاط حتى يصل إلى النتيجة التي يريدها:
🔹 إثبات الدين:
يجب أن يكون الدين موثقًا بمستندات رسمية أو تجارية مثل الفواتير أو العقود أو المراسلات المعتمدة.

🔹 الإخطار:
ينبغي إرسال إخطار رسمي بالدفع إلى المدين، مع تحديد مهلة قانونية للسداد قبل اتخاذ الإجراءات القانونية.

🔹 الطرق القانونية للتحصيل:
في حال عدم السداد، يمكن للدائن اتخاذ الإجراءات التالية:
✅ المطالبة الودية والتفاوض: يمكن بدء المحادثات مع المدين بشكل ودي، والتوصل إلى تسوية أو جدولة للسداد قبل اللجوء إلى الإجراءات القانونية.
✅ رفع دعوى مطالبة أمام المحاكم المختصة.
✅ اللجوء إلى التنفيذ الجبري إذا كان هناك سند تنفيذي كحكم قضائي.
✅ المطالبة بالتعويض عن التأخير في السداد.
