Trustees often take on more risk than they realise, especially when entering contracts on behalf of a trust. It is a common misconception that when signing documents in your capacity as a trustee, your risk is limited to the assets of the trust. Unfortunately, this is not the case. A contract that is enforceable against a trustee can be enforced against the trustees (or any one of them) personally.

It’s a timely reminder for anyone acting as a trustee to understand the trust’s financial position and the obligations they’re signing up to.

Caveats are an important tool for protecting people’s rights over property — but they’re not something to register lightly. As the article explains, “a caveat is a legal instrument that can be registered against a property title to protect a person’s rights or interests in respect of a particular property.”

In summary, a caveat is a robust tool for protecting one’s rights and interests over real property. It is important to receive sound legal advice on the effects and implications of registering a caveat, due to the risks and consequences associated with registering one incorrectly.

If you have any questions or would like to know more, our team is here to help.

Death, Property & Prenups

Many couples sign prenups early in their relationship and then never look at them again — even after major life changes. “It is the prenup (not the will, property law or the intestacy rules) that governs what part of the relationship property forms part of the deceased spouse or partner’s estate.”

It’s a timely reminder to ensure your prenup and your will still reflect what you want to happen when you die. If you have questions about how your agreement applies, our team is here to help.
