Clients - both vendors and purchasers - often mention the deposit payable under the Agreement for Sale and Purchase as being the sum that they will lose if they default on the contract.

I am always at pains to ensure that they understand that loss of a deposit for failure to settle doesn't even come close to their liability in breach of contract.

A great outcome for the purchasers of these tiny homes (well not as great as it would have been had the builder not been liquidated and had finished the builds as planned - but still a better outcome than would ordinarily be expected in such a situation).

The Court has ruled that following the builder's liquidation, the purchasers have an equitable lien in their tiny homes and may take ownership of them. If not for this court ruling, the tiny homes under construction for these purchasers would have been added to the liquidator's pool of assets and used to meet creditor demands.

We are noticing a settling down in the property market. After 2 years of frantic activity and a landscape of multiple offers, the property market seems to be calming down.

We are still seeing buying and selling but with more realistic timeframes, buyer conditions rather than unconditional contracts and a slight easing on prices.

Following today's announcement that the whole of New Zealand (except Auckland) will reduce to Covid-19 alert level 2 from midnight Tuesday 7th September 2021, I'm pleased to confirm that we will be back in our office at 4 Starlight Arcade, Taupo from 8.30am Wednesday, 8th September 2021.

If you have an appointment with Nicky or Carolyn or need to see us in person, we ask you to please remember the following things:

1. Wear a mask;

2. Scan in to our office - the Covid-19 QR poster is on the outside left entrance door OR if you do not have a scanning device, please ensure you complete a sign in slip and drop it in the box inside our office waiting area;

4. Observe social distancing protocols requiring 2 meters distance in public places including business premises;

4. If you are unwell - stay at home and telephone us instead - we can always arrange an audio-visual call if you need to "see" us;

While property settlements involving the movement of people can now take place, lawyers and conveyancers still CANNOT meet clients face to face.

Changes are a few months away, but well overdue.

House price caps are set to be indexed to actual house price sales.

Long overdue - I can count on one hand the number of my clients who have actually managed to access a first home grant to purchase a property this year.

The number of first home grants paid out this year is on track to be the lowest since the scheme began in 2014.

Wow… settled out of court. A huge blow to the leaky home owners taking part in the class action.
