As the NZ Herald says, we take a ‘stronger stance’ to Maori rights in freshwater than the New Zealand Maori Council.

We want the Government to recognise that Maori have native title in their waterways, and allow our clients to protect their waterways accordingly.

If the Government refuses to acknowledge the nature of Maori rights, there will be a battle in court.

Morena whanau 🙂

Today is Day 3 of the Freshwater Inquiry hearing in the Waitangi Tribunal.

Yesterday we presented submissions on behalf of our clients: we spoke to the degradation of their waterways that has occurred under the RMA framework and the failure of the Crown to recognise their customary ownership rights (native title) in their awa.

The Crown says ‘no one owns freshwater’—we say this position is politically convenient and not based on fact or law.

We are asking the Tribunal to recommend that the Crown recognise hapu rangatiratanga and allow our clients to fulfil their role as kaitiaki.

Watch this space for more inquiry updates!

Today is the first day of the Waitangi Tribunal inquiry into freshwater and geothermal resources.

We are here on behalf of hapu and whanau, who have been trying for decades to protect their waterways from over-allocation and pollution, and to have their customary rights in their waterways recognised.

Today counsel for the NZ Maori Council is presenting submissions on the failings of the Resource Management Act, and their call for an independent Water Commission

For our clients—we will be presenting submissions on your behalf tomorrow afternoon. Whiitiki koe!
